Oc;.ar t.n agreement between the Atomic Energy Cetomission and the State of Georgia for the transfer to the State of certain of the Connission's regulatory authority over byproduct, source and special nucicar eaterials will become effective on December 15, 1969. A copy of the agreement and.of Part 150 of the Commission's regulations, which describe the scope of the transferred authority,

are available from this office upon request.

In determining the status of your AEC license on the effective date of this agreement, th'e following conditions will apply:

1.

If you are an AEC licensee located in Georgia, the State will recognize your existing license as a State license for a period of ninety days af ter your receipt from the State of a notice of expiration or until the expiration date specified in the AEC license, whichever is earlier.

2.

If you are an AEC licensee located in Georgia and authorized to conduct acti'vities in other non-Agreement Sta tes (i.e., S ta tes in which the AEC retains regulatory authority), the AEC license vill continue to be valid in the other S ta t e s.

3.

If you are an AEC licensee located out of Georgia but under your present AEC license are authorized to use radioactive materials within Georgia, you should contact the State authority for information regarding your activities in Georgia after December 15, 1969.

Notwithstanding the above three categories, licenses issued by the AEC to Federal Governmer; agencies opera ting in Georgia will remain under AEC jurisdic-tion. Therefore, there will be no change regarding licensing procedures for Federal agencies.

All communications with the State of Georgia on this matter should be addressed to:

Fetz, Director Radiological Health Service Georgia Department of Public Health State Health Building Atlanta, Georgia 30303 To date, the AEC has entered into agreements with the following States in addition to the State of Georgia: Alabann, Arizona, Arkansas, California, Colorado, Florida, Idaho, Kansas, Kentucky, Louisiana, Mississippi, Nebraska, New Hampshire, :lew York, North Carolina, North Dakota, Oregon, South Carolina, Tennessee, Texas and Washington. The AEC continues to exercise full regulatory authority in all other States at the present time.
