C. 20555 SEP 5 1975 Gary Snyder, Enforcement Coordinator, IE:I JERSEY CENTRAL POWER AND LIGHT COMPANY - PROPOSED CIVIL PENALTY In accordance with our telephone discussion on September 2, 1975, the amounts of the monetary penalty for each item of noncompliance in the Notice of Violation will be reduced to the extent that all items related to any one Critierion will be equal to the amount set out in the Chapter 0800 guidance for an item of noncompliance in that category.
The items of noncompliance have been reviewed in your office and the Region feels that they are properly categorized.
Although there are items of noncompliance with several of the Criteria in Appendix B of Part 50, it appears that many of the items are procedural in nature and have minimal safety significance.
While it is true that a breakdown in Quality Assurance can be demon-strated by establishing items of noncompliance with the requirements of several Criterion in Appendix B, such matters of noncompliance i
must involve matters of real safety significance. The significance of the items of noncompliance should be commensurate with and justify the conclusion that there is a breakdown in Quality Assurance.
It is also noted that the total action points of 86 for this case is somewhat less than the 100 action points normally used as guidance for the civil penalty sanction.
In view of the matters discussed above, please submit to Headquarters a justification for the conclusion that the items of noncompliance demonstrate a breakdown in Quality Assurance. If there is a break-down in QA, please indicate the justification for not suspending the license in the interest of the public health and safety.
Also indicate the justification for the civil penalty sanction based on the 86 action points tabulated for this case.
