Dear Mr. Carroll:
The Huclear Regulatory Comntission has published a proposed rule (39FR32921) which would prohibit disposal by burial in soil of all radioactive wastes containing more than 10 nanocuries of transuranium elenents por gram. A cop'/ of this proposed rule is encloacd. Waste containing transuranium conecutrations greater than this will be re-quired to be transferred to the Federal Government for storage.
Although the Statement of Considoration for this proposal indicaten that rodwaste
.f from nucicar reactors would not generally be considered transuranic waste, some concern has been expresocd regarding the need for licenscos to measure these concentrations routinely.
Sinco data regarding quantitico of tranauranium elements in all types of solid wasten frou reactors is very limited, we fcol that a sat of actual measurenents of severni nuclaar pma.ar plenta "culd ellev uc to provide cerc acfinitiva suidancu in the tinat 5tatement or consideration.

regarding the possibility of obtaining representative samples of Oyster Creek solid unste.
It is our understanding that such sampics can be readily obtained.
We would like Oyster Creek to be one of the plants participating with us in this study by providiny, a small number of solid vaste samples. Our contractor for this project, Allied Chemical Corp.,
Idaho Falls, Idaho, will provide adequate shipping containors and instructions.
The results of the analyacs of Oystor Creek vaste will, of courae, be made available to you.
In addition, if these data are to be mada public, in any written form, you will have the opportunity to review such document prior to publication.
