In our view it s a State matter and was resolved by the enclosed letter, dated January 22, 1974, to Jersey Central Power and Light Company from New Jersey's Bureau of Water Pollution Control.

The enclosure was obtained as a result of discussion between L. Higginbotham and Licensing's Environmental Projects.

On September 11, 1973 this office issued a letter, con-ceptionally approving a preliminary enginecring report for the construction of wastewater treatnent facilitics to treat chromated wastewaters currently being stored by the J.csey Centr'al Power and Light Company at the Nuclear Generating Station at Oyster Creek.

Souc tinc in early November 1973, Mr. liarding, Supervisor of-the industrial Control Unit, discussed the status of final engineeriny. plans and specifications for this treatncnt facility with you by telephone, and you indi-cated at that time that final plans and specifications 1

would be subnitted to this office within a short period of time. _This office has not roccived any plans or specifications for the subject waste treatment facilitics i

as of the date of this letter.

The recent spill of the untreated chromated waste on Deconber 20, 1973 only magnifics the necessity of installation of the proposed treatnent facilitics at the carliest possibic tino.

Therefore, you arc hereby directed to-submit. final engineering plans and speci-fications for the proposed: treatment facility to this office on or before February 15, 1974.

The failure of this office to roccive said final engineering plans and specifications as of the fiftcenth of February 1974 will leave this~ office'no recourse but to refer this natter to our_ Enforconent Unit for appropriate icgal action.
