By letter dated January 18,1973, you requested authorization to load and operate the Oyster Creek reactor core in the configuration described in Facility Change Request No. 4.

By letter dated Fbbruary 22, 1973, you submitted Supplement No. 1 to Facility Change Request No. 4 that changed the fuel assemblies to be loaded during this refuelirg fmm Type IIIB to Type IIIE.

We have reviewed this Change Request and its' Supplemnt and in regards to the pertinent safety considerations for the loading of the fuel as described, we have concluded that the proposed loading does not pre-I sent significant hazards considerations not described or implicit in the Safety Analysis Report and that there is reasonable assurance that the health and safety of the public will not be endangered by the loading of the 148 fuel asserblies as described.

However, by letter dated April 3,1973, we requested additional infor-mation that we required in order to complete our evaluation of fuel densification and its effects cn nomal operation and the loss of coolant analysis and the XN-1 correlation. We have not yet received this infomation.

In addition, your submittal of the appmpriate Technical Specification changes has not yet been received. 'Iherefore,

authorization to operate with this reload com cannot be granted at this time.

Accordingly, pursuant to 10 CFR Part 50, Section 53.59, you are hereby authorized to load the 148 EXXON Type IIIE fuel asserblies in 'he con-figuration described in Facility Change Request No. 4 and Supplemnt No. 1 thereto.
