NOTE TO J.'P. O'REILLY, REGION I CIVIL PENALTY FOR OYSTER CREEK l

As discussed with you, we have-rdexamined our decision on a civil penalty on Oyster Creek for failure to report the snubber problem" when originally detected.

In this case, a civil penalty will.not be issued due, principally, to the following:

1.

The case does not meet the specifically published criteria for i

civil penalties, 2.

The case would establish a precedent on an ad-hoc basis which we believe should be considered as a part of a currently undertaken review of the entire enforcement program.

As discussed with you, it is my understanding that Region I will take specific enforcement action in this case, consequently, i

Regulatory Operations Headquarters will not correspond with the licensee concerning the failure to report the snubber problem.
