APPARENT NONCOMPLIANCE WITH 10 CFR 50.55a(h)
(IEEE 279) PARAGRAPH 4.22 - IDENTIFICATION OF COMPONENTS (MIDLAND) - (A/I F30375Hl)
The attached memorandum documents a recent inspection finding which we believe warrants evaluation by NRR. The matter deals with a change that Consumers Power Company (CP) made to the Midland FSAR involving identification of Class lE components.
In our view, this change violates a regulatory requirement (10CFR 50.55a(h)) that is applicable to the Midland site (CP issued December 14, 1972).
However, the licensee strongly disagrees with this finding on the basis that NRR agreed with this change prior to the change being incorporated in the FSAR.
This matter has been identified as an unresolved item in the inspection report pending further review by Region III. Therefore, we request that you take the necessary action to have NRR evaluate this matter and provide IE with an answer as-to the acceptability or nonacceptability of this FSAR change.
