I, DeVerne G. Dunnum Jr., being duly sworn, depose and say:

I am a QA Supervisor for the H.P. Foley Company, responsible for-research and response to employee quality concerns and NRC inspections related to allegations concerning H.P. Foley's Quality Assurance Program.

1. I am rGsponding to the Joint intervenors' allegation a2 page 31, paragraph 109 of their Motion and the supporting erroneous statement at page t

,.s 5, paragraph 3 of the anonymous af fidavit dated January 16, 1984. The '

statement that, "When Foley's night shif t assistant manager told his '

management about the problem, it was implied that he was to keep quiet about it or else he would be fired."

2. Mr. Bob Knowles, H.P. Foley's Staff Electrical Engineer, has indicated that he was the one who discovereu some materials for the incore thermocouples wer.e purchased as non-Class I and the assigned inspector was Mr. Dennis C.

High, who ultimately became H.P. Foley's night shift Q.C. Manager, or the

" night shift assistant manager," as referenced above.

3. This allegation is incredible when the facts are revealed. During my duties of researching the issue, I contacted Mr. High via telephone on March 12, 1984. He described to me, at the time, he was the QC inspector assigned to write a nonconformance report (NCR) on the beta shield and supports. This

(~ NCR was necessary because of Engineering's discovery that some of the material was purchased as non-Class I. An NCR was written on February 18,1982, and imediately processed into the system. The NCR fully described the problem and the proposed corrective action. I asked Mr. High if all the problems found were described in accordance with the approved H.P. Foley quality assurance program. He stated they were. When I asked Dennis High what his duties were with H.P. Foley, he responded that initially he was assigned as a QC ir.spector for civil work. Seven to eight months later he was transferred to the electrical group as a Level II inspector during the thermocouple work.

He stated he was offered a QA engineer position on Spetember 27,1982,' which

, he accepted. He then indicated that Virgil Tennyson (his QC supervisor)

, offered him a QC supervisory position, but he deciined the offer due to his i

involvement with the local union activities and especially the current contract and wage negotiations. Ultimately, he was offered the QC night shift manager position which he wanted and accepted on December 20, 1982.

4. Further research resulted in a personal conversation with Mr. High at a place near his residence on March 14, 1984. Present with me was Mr. Dick Twiddy, Pacific Gas and Electric Quality Assurance. I specifically asked tir.

High if he had ever been -intimidated or threatened with his job in regard to the thermocouple situation. He responded tnat no one ever threatened him or intimidated him. -

5. When I asked him why he resigned from H. P. Foley on January 27, 1983, he responded he quit because he didn't feel that his supervisor was performing his duties in regard to management and providing Mr. High with enough personnel to do his job, especially in the futl handling building.
6. Considering both Dennis High's statements to me and the records concerning this matter, I feel certain that no one ever suggested to him that

(' he should keep quiet about the incore thermocouple problem and that he was not threatened with loss of his job.
