I, Mark W. Stephens, being duly sworn, depose and say:

I am currently employed by Pacific Gas and Electric Company as an Instrument Foreman in the Nuclear Plant Operations Department.- I am submitting this affidavit to respond.to allegai..sns 1123 and 125 contained in the Joint Intervenors' Motion.

1. In regard to identification and documentation of problems at Diablo Canyon Power Plant, the following was, to the best of my knowledge, the C most stringent guideline given to anyone working under my direction.

This guideline was to verbally review the problem with me before submitting it to the problem report processing systam. This was done in an effort to assure that problems were both valid and correctly described. Problem reports were occasionally cancelled when it was determined that the problem was invalid, when the problem was found to also be reported on another problem report or on some other form of discrepancy report, or when identification of the problem by some other mechanism would be more appropriate. In most cases, this was dene after mutual agreement between the originator and myself. In no case were any valid problem reports discarded.

2. During the period in which I was responsible for the direct supervision

of instrument maintenance personnel (1976 through 1982) t..ere was never any attempt to suppress identification of problems. Furthermore, as a matter of principle and practice, discovery and identification of problems was encouraged.

3. In addition, where practicable, personnel identifying problems were given the opportunity to be involved in their resolution by participating in such activities as making necessary repairs, revising procedures, and writing design comments and reconraendations.

ALLEGED THREATS BY CRAFT PERSONNEL ON QC INSPECTOR (STEVE HOPPER). ,

On Apr117,1983 Mr. Hopper came back on the jobsite in the early afternoon to turn in his resignation. The circumstances leading to this .

decision were discussed at length, first with Joe Watson- (QC Leadman),

Pat Watson (UA Steward), Frank Lyauty (Assistant QA/QC Manager) and myself.

The conversation was basically identical as described in Mr. Hopper's letter of 4/7/83. Mr. Hopper was told that these conditions would not be tolerated and there would be no need for him to resign, and the situation would be -

brought to the attention of Pullman Power Products site- management.

Shortry after our discussion Mr. Hopper was requested to reiterate o his concerns in your presence. -Construction Superintendent, R. Fau11 was in attendance with all parties mentioned above wita .the exception of Joe Watson. Mr. Hopper's story was basically the same as previously stated. -

Mr. Faull was requested to investigate the situation with the night shift supervision. Mr. Hopper was again told by Management, that these conditions would not be tolerated and if need be, he would be transfered to the day shift,. or to a different area, or could take a few days off until. the situa . . i.

tion was investigated and resolved. Mr. Hopper elected to implement his - .- --

resignation.

Mr. Hopper indicated that he had written a letter which he intended to l bring' with him, but had forgotten it. He indicated he would send me a copy.

The next day, I was infomed that two of the Craft Personnel involved l

had indeed not maintained the preheat, as stated by Mr. Hopper and were sub-sequently terminated.

Occasionally, differences of opinion and personality conflicts do occur, which are hand'ed on a case-by-case basis. There are no instances known to me where intimidation or threats are tolerated by QC, QC Leadman, myself or Management. Conditions outside of procedure tolerances are either corrected at the time of discovery', or through the documentation required by the QA Program.
