ORDER August 11, 1982 On August 6, 1982 the State of Louisiana filed a notice of appeal from an April 20, 1982 Licensing Board order. 1 That order denied the State's petition to participate on an  ;

issue initially raised by the Board sua sponte but subsequently withdrawn. The Licensing Board's April 20 order advised the State that it "may, however, pursuant to 10.C.F.R. S 2.714 (a) (1) or S 2. 715 (c) , file a petition for leave to intervene or to participate and set forth therein the specific aspect or aspects of the subject matter as

2 to which the State wishes to interven,e or to participate."

On July 21 the State of Louisiana filed a new such petition, which is currently pending before the Licensing Board.

Because it may be unclear under our procedural rules whether the State's appeal should be treated as one under 10 CFR 2.714a (which directs that a brief in opposition must be filed within 10 days after service of the appeal) or under 10 CFR 2.762 (which specifies a longer time frame for briefing), we request that applicant file its brief in response to the State by August 23, 1982 and that the NRC staf'f respond by August 27, 1982.
