l ORDER October 30, 1978 On October 27, 1978, the Licensing Board entered a partial initial decision in this construction permit proceeding.

l LEP-73-34, 8 NRC That decision addresses a number of the environmental and radiological health and safety issues presented in the proceeding.

Nonetheless, in neither area does it make the ultimate findings recuisite to the issuance of construction permits or limited work authorizations for the Perkins facility.

This is because, for the reasons set forth in the decision, the Board is to receive additional evidence en acth certain generic safety matters and the ~uestien *hether thera is an "chvicusly superior" alternate sits for the 1ccation of the facility.

, (. Given the wholly interlocutory character of the October 3

27 decision, we are disinclined to review -(either on an appeal or on our own initiative) the matters considered and determine'd in it until after the Board below rules upon the remaining issues.

This presumably will be accomplished in a single decision, once the additional evidence on those issues has been adduced.

Accordingly, the 10 day period provided by

the Commiss.on's Rules of Practice for the filing of exceptions s

L to the October 27 decision is hereby tolled on our own motion.

That period shall commence to run upon the service of the further decision of the Licensing Board.

Any party desiring to file exceptions to either or both of the decisions may do so at that time in a single document.

This order nas no application to the July 14, 1973 partial initial decision which was-confined to the radon issue.

L3P-78-25, 2 UEC Exceptions to that decision were timely filed and this Soard intends to proceed to consider them without awaiting tha l

ultimate action of the Licensing Ecard on the construc-tion permit applications.
