Stanley Livingston In the Matter of ) Docket No. 50-255-0LA CONSUMERS POWER COMPANY (Palisades Nuclear Power Facility) June 23, 1982 MEMORANDUM AND ORDER REGARDING STATUS OF PROCEEDING On January 29, 1979, the Comission published a notice in the Federal Register captioned " Proposed Issuance of Amendment to Provisional Operating License." 44 Fed. Reg. 5732. Thereafter, on March 9,1979, a licensing board was established to " rule on petitions for leave to intervene and/or requests for hearing and to preside over the proceeding in the event that a hearing is ordered." On May 9, 1979, the licensing board held a prehearing conference on this matter in St.

Joseph, Michigan. On July 23, 1979, the licensing board issued a special prehearing conference order which admitted Great Lakes Energy Alliance (hereinafter "GLEA") as a party to the proceeding and further admitted three of GLEA's contentions. It is noted that the first contention alleged that a NEPA environmental impact statement was required due to the significant total man-rem exposure resulting from 8206280537 820623 DR ADOCK 05000 [,2

e the steam generator replacement. The other two contentions dealt with the requirement that occupational radiation exposure be kept as low as is reasonably achievable and that Consumers' Steam Generator Repair Report does not adequately consider the impact of construction on the surrounding resort area environment. Thereafter, on March 20, 1980, counsel for the NRC Staff stated that, "in view of the Cmanission's Order in Surry [VEPCO,11 NRC 405 (1980)]...the Staff will prepare an environmental impact statement regarding the replacement of steam generators for the Palisades facility." There has been no further activity in this matter.

In order to determine the present status and future course of this matter, the licensing board needs additional information from the parties.

WHEREFORE, IT IS ORDERED that on or before July 12,1982, each party to this proceeding shall file a statement which shall include the following:

1. The current status of this matter including:
a. Whether Consumers presently intends to replace the steam generators at Palisades;
b. The date on which the Staff completed or will complete its environmental impact statement; w-. . . . . _ ._....__U
c. The discovery which has been completed and further discovery which is needed prior to hearing; and
d. Whether each party believes that a hearing is needed in this case and (1) If so, the reasons for such belief and the party's best estimate of the length of time of such a hearing; (2) If not, the reasons for such belief and the party's suggestion for the means to resolve this matter without the necessity of a hearing, j 2. A statement of any remaining issues in this matter and the party's recommendation concerning each such issue.
