,1 NRC STAFF MOTION FOR EXTENSION OF TIME TO ANSWER PETITION FOR LEAVE TO INTERVENE g
On September 15, 1977, the Commission published a notice of consideration of the applications of the General Electric Company (GE) for renewal of the referenced licenses in the Federal Reaister, 42 F.R. 46427. This notice provided, inter alia, that by October 17, 1977, anyone whose
, interest might be affected by this proceeding could submit a request for hearing in the form of a petition for leave to intervene in accordance with 10 CFR 5 2.714.
On October 14, 1977, a timely petition for leave to intervene was filed by Jed Somit, Esq., on behalf of named individuals and organizations.
In accordance with 10 CFR 55 2.714 and 2.710, the NRC Staff's answer to this petition would be due on October 27, 1977.
However, for good cause 1
l hereinafter shown, the Staff requests, pursuant to 10 CFR 5 2.711, an extension of time until November 23, 1977 in which to file its answer.

0 Subsequent to its receipt of Mr. Somit's petition, the Staff became aware of information' confirming the existence of faulting within about two hundred feet of the GETR site.
As a result, the Staff has been engaged in a continuous effort, including a visit to the GETR site vicinity on October 22 and discussions with GE, the U.S. Geological Survey, the State of California and numerous other organizations, in an attempt to assess the"immediate impact of this newly discovered infor-mation on the continued operation of GETR and other NRC-licensed activities at Vallecitos Nuclear Center.
Consequently, on October 24, 1977, the Staff issued an Order to Show Cause to GE, suspending operation of GETR on October 27, 1977. O The in'volvement of the Staff and its Counsel have prc~ vented meaningful consideration of l'r. Somit's petition.
Counsel for the Staff has discussed the requested extension of time with
, Counsel for GE and Mr. Somit, and is authorized to represent that they have no objection to it.
We understand that GE is requesting an exten-sion of time in which to respond to Mr. Semit's petition until November 18, 1977 and we have indicated that we do not oppose this request, a factor the Staff considered in then seeking an extension until' Novem-ber 23, 1977.
l E ee letter from Counsel for NRC Staff to Board dated October 26, S
1977, enclosing a copy of the Order to Show Cause.
3 Accordingly, for good cause shown, the Staff respectfully requests an l
i extension of time until Novem5er 23,1977, in which to file its answer to Mr. Somit's petition.
Respectfully submitted, a* <l'i. 4 i
