SUBJECT:
RI-91-A.0134, AND RI-91-A-0029 He Chief of Reactor Projects Section 4A received an allegation (RI-91-A-0091) by 1.
telephone on May 6,1991 concernmg compliance with General Design Criterion (GDC) 17, and possible harassment of licensee corporate technical staff.
Compliance of Millstone Unit 2 with GDC 17 has been the subject of correspondence that you provided to DRP on April 12, 1991. We have requested NRR review of this matter in a Task t
Interface Agreement dated May 20,1991 (attached). We do not, at this time, have sufficient information to make a referral to your office regarding the potential harassment issue.
However, if additional information is obtained, we will inform you, as appropriate.
Allegation RI-91-A-0134 is an employee discrimination allegation made anonymously by 2.
telephone to a Millstone resident inspector. De individual was informed of the DOL procedures and given the appropriate DOL contacts during the telephone call.
Suksequently, we sent to the alleger (thru a third part) a copy of 29 CFR 24, " Procedures for the Handling of Discrimination Complaints." Due to a lack of specific information, no further action is planned. Since 30 days has passed since we last heard from the alleger, this allegation is considered closed.
On January 23,1991, the NRC rtreived an allegation (RI-91-A-0029) from a Millstone 3.
employee who claimed that be had been harassed subsequent to his informing the Millstone Nuclear Safety Concerns Program of an issue. When informed of his rights to file a claim with the U.S. Department of Labor, the alleger declined stating that he intended to pursue the matter using the employee grievance procedures in place at Millstone. On July 15,1991, Region 1 (Stewart) contacted the alleger to determine the status of his grievance. The alleger stated that the grievance had been settled to his full satisfaction and that be no longer had any concerns regardmg this matter. Since the alleger's concerns were addressed within the licensee's grievance system,- it is not apparent that he was harassed by the licensee. Herefore, this allegation is considered closed.
