. STEN 0 GRAPHIC REPORTING CONTRACT This is to appris~e you of the current status of the stenographic reporting contract which was the subject of my May 5,1982 note to you (copy attached).
The issue is whether only small businesses should be allowed to bid on the contract.
Bill Kerr feels small business could do this work, while S. Chilk (a primar meetings)y user because of the contractor's involvement in Commissionis very business, Chilk does not wish to take the risk of perhaps getting an unsatisfactory contractor, such as occurred with the last small business contractor, IVRI.
The Small Business Administration has recommended a small business setaside. We feel that there is a good chance that SBA will appeal to the Chairman if we do not concur in SBA's recomendation.
The Division of Contracts does not think that we have a strong enough argument to justify rejecting the SBA recommendation and has proposed an alternative in an attempt to satisfy Chilk's concerns.
Rather than have price as the primary selection criteria, the Division of Contracts has proposed that this procurement be negotiated so that technical approach, personnel and management of the firms proposing will be primary.
This procedure will allow only small businesses to compete but would leave the selection process totally in our hands based upon the criteria we consider important.
This idea has been presented to Chilk; however, he is not persuaded and is now canvasing several Commissioners to determine their attitude should this matter reach them for decision through an SBA appeal.
It is important that a decision be made promptly since the GA0 has received a protest from the firm represented by Joe Gallo charging the NRC with dilatory tactics.

t Chilk promises to let us know by the end of the day what his final position is.
If we have not heard from him by then I propose we move forward with the small business setaside along the lines recommended by the Division of Contracts.
