MARKING OF DISCLOSURE CONTROLS ON PENDING ENFORCEMENT CASES EGM 89-02

.This EGM reiterates the importance of and expands on the guidance provided in EGM 88-03. To avoia-inadvertent public disclosure, there is a continuing need to ensure that all proposed enforcement packages are appropriately marked before transmittal to Headquarters. The regional transmittal memoranduni should contain j

the following caveat in capital letters at the bottom of the first page:

-the bottom of the first page of the draft cover letter to the licensee. This should, of course, be removed when the letter is given final printing for signature and issuance. These caveats should appear in the materials as they 5

are transmitted via the 5520 system as well as hard-copy.

Also, when safeguards information is transmitted on the 5520 system, the cover-sheet and the first page of both the transmittal memorandum and the enforcement action should contain the following additional caveat:

SAFEGUARDS INFORMATION - HANDLE IN ACCORDANCE WITH 10 CFR 73.21 It is also important to ensure that materials are not left in the system without retrieval ano printing by the addressee office.

Some of you are already calling the receiving office and advising that you have sent an enforcement package via the 5520 system.

I would appreciate it if all regions did so.
