FIRE PROTECTION MODIFICATIONS POINT BEACH NUCLEAR PLANT, UNITS 1 AND 2 In our letter dated January 20, 1981, we requested a completion date extension for one of the Point Beach Nuclear Plant fire protection modifications listed as item 3.1.31 of the NRC Staff's Fire Protection Safety Evaluation Report.

In your letter dated April 1, 1981, you characterized this request as an application subject to the provisions of 10 CFR 170.22 and requested that we promptly submit a fee of $1,600 for the NRC Staff's review of our request.

Section 170.22 of 10 CFR is labeled " Schedule of Fees for Facility License Amendments." This section is purported to include the schedule of amendment fees for reactor fr.cility permits, licenses, and other approvals required by the license or Comission regulations. Our request for the extension of a completion date specified in a safety evaluation report does not fall within any of these categories. Although Mr. Schwencer's letter to Wisconsin Electric dated August 2, 1979 included a new license paragraph which authorized and required the licensee to proceed with modifications identified in the NRC's Fire Protection Safety Evaluation Report (SER) or supplements, our request required no changes to this license provision.

As you know, this request for extension was granted in Mr. Denton's letter dated February 13, 1981. Since this extension involved no changes or amendments to the facility operating licenses or supplement to the SER, it is our position that no fee is required or justified for this action.
