EXEMPTION REQUEST - FIRE PROTECTI0!i RULE SCHEDULAR REQUIREMENT OF 10 CFR 50.48(c) - POINT BEACH MUCLEAR PLANT UNITS 1 AND 2 The Fire Protection Rule, (10 CFR 50.48) published on Novenber 19, 1980, becane effective on February 17, 1981, and required the results of certain tasks to be submitted to the Nuclear Regulatory Connission (HRC) by llarch 19, 1981. By letter dated March 18, 1981, you applied for exenption from some of these schedular requirements of 10 CFR 50.48(c). The exenption reqJested related to the tino allowed to complete a reassessnent of the fire protection features at your plant for conformance to the specific requirenents of Section III.G of Appendix R to 10 CFR 50; to evaluate the difference deternined for each area; and to design modifications to neet the requirements or provide a justifiable basis by neans of a fire hazards analysis for an exenption from such requirenents.

In addition, your letter of March 18, 1981 requested schedular exemptions frrr1 the implenentation dates for nodifications required by Section III.0 and certain substantive exenptions from the requirenents of Section III.lf of Appendix R to 10 CFR 50.48. The latter of these exemption requests was addressed by the staff's letter of May 4,1981 which denied this exenption request and will not be discussed here. For reasons as stated in your exemption request, you requested additional time to conplete the above reassessments, evaluations and designs. By letters dated April 4,1981, October 2,1981 and January 29, 1982, you revised your request.

Your latest submittal included an enclosure giving your evaluation, plans l

and descriptive diagran in accordance with the requirenents of Section 111.0 of Appendix R to 10 CFR 50.48.

It also requested schedular exenptions for implenentation of sone portions of Sections III.F and III.t1 of Appendix R.

Subsequent to your latest submittal, by telephone conversation on April 6, 1982, nenbers of your staff indicated that your expected conpletion date of March 1,1982 was not net with respect to fire barrier rodifications and circulating water punphouse fire protection nodifications but in actuality these itens were coop'ljeted a few days later than March 1,1982. Further, you expect conpletion of the fire detection system nodifications to extend beyond the June 1,1982 completion date identified in your latest subnittal.

The Comatission has granted your request as described in the enclosed Exemption (Enclosure 1). The Exenption is conditional upon a requirenent that the subnittal be complete, as defined in the Exemption.

If the NRC should detemine that your suhnittal is not complete, you will be found in violation of 10 CFR 50.48(c).

Such a violation will be a continuing one froat the date granted by the Exemption and a civil penalty nay be imposed for each day the violation continues.

A copy of the Exenption is being filed with the Office of the Federal Register for publication. provides a rewording of the request for infomation included with Generic Letter 81-12. This rewording is the result of neetings with repre-sentative licensees who felt that clarification of the request would help expedite responses.

It does not include any new requests and, therefore, will not adversely affect licensees' ability to respond to Generic Letter 81-12. provides infomation regarding our criteria for evaluating exenption requests from the requirements of Section III.G.2 of Appendix R.
