Dear Mr. Miller:

Wisconsin Electric Power Company (" Wisconsin Electric") has asked us to respond to your letter of May 22, 1981 regarding fees for approval of extension of time to comply with fire protection requirements of 10 CFR 550.48 for the Point Beach Nuclear Plant.

We concur with the position taken by Wisconsin Electric in Mr. C. W. Fay's letter to you of April 23, 1981 that the appli-cation for extension of time for compliance is not an amendment and is therefore not covered by 10 CFR S170.22. The regulation in question is~ entitled " Schedule of fees for facility license amendments." Wisconsin Electric's letter of January 20, 1981 made no request for an " amendment" or change of any type in the substance of the reactor facility license. g

Miller Page Two June 5, 1981 Wisconsin Electric's application addressed the time schedules established by regulation in 10 CFR 554.48 and requested an exten-sion of the implementation date in accordance with the provisions of that section. The requested action was taken by letter and notice dated February 13, 1981, " pursuant to 10 CFR 550. 4 8 (d) ',

and was not in the form of an amendment to the reactor facility license.

Furthermore, the NRC Staff apparently considered that Wisconsin Electric's January 20, 1981 application was not an appli-cation for an " amendment" at the time that the application was ap-proved by the Director, Office of Nuclear Reactor Regulation.

, Section l?O.12 (c) provides that "the appropriate amendment fee shall accompany the application for amendment when filed by the Commission." Section 170.41 provides that the Commission "will not process any application" whore a prescribed fee has not been paid. Since the NRC did in fact process (and grant) Wisconsin Electric's application, the NRC must have aF3umed (Correctly) that 10 CFR S170.22 did not apply in this case.

For these reasons, we believe that the schedule of amendment fees contained in 10 CFR S170.22 does not apply to the action re-quested by Wisconsin Electric. We believe, therefore, that payment of the requested fee is not required and have advised the company accordingly.
