SUBJECT:
CLARIFICATION OF PHYSICAL SECURITY RULES AND REGULATIONS Yosr May 5,1981 letter requested us to determine if the requirements contained in 10 CFR 73.71(c) were applicable to the Rancho Seco Nuclear Generating Station. You also requested clarification of guidance given in Regulatory Guide 5.62, " Reporting of Physical Security Events".
With regards to the applicability of 10 CFR 73.71(c), Rancho Seco was issued a specific license under the provisions of 10 CFR 50.20 to operate a utilization facility for industrial or commercial purposes and is therefore subject to the requirements of 10 CFR 73.71(c).
Regarding your second concern on the guidance pr6vided in Regulatory Guide 5.62, the fourth paragraph on page 5.62-2 states, "A moderate loss of physical security effectiveness...for a ohysical security ystem occurs under any one of the following conditions anu should be reported to the NRC within 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br />." The first condition identified is a major loss of physical security effectiveness which was properly compensated for and thus downgraded to a moderate loss. Such events must be reported within 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br />. By contrast, events which are initially categorized as moderate and which have been properly compensated for need only be recorded in the licensee's records.
With respect to the reporting of a " procedural violation without malicious intent", such as incident (as described in your example) would not.be con-sidered to be a loss of effectiveness as long as it did not allow the unauthorized and undetected access of the individual to the vital area.
However, such incidents, whether malicious or not, that allow the unauthor-ized and undetected access of an individual to a vital area would be con-sidered to be a major loss of effectiveness, unless properly compensated for, and therefore reportable within one "our.
