MOTION OF HOUSTON LIGHTING AND POWER COMPANY FOR EXTENSION OF TIME WITHIN WHICH TO RESPOND TO THE MOTION OF THE DEPARTMENT OF JUSTICE TO COMPEL PRODUCTION BY HOUSTCN OF CERTAIN DOCUMENTS WHICH HOUSTON CONTENDS ARE PRIVILEGED In accordance with Section 2.711 of the Commission's Rules of Practice, 10 CFR 52.711, Houston Lighting & Power Company (Houston) hereby respectfully moves the Board for an extension of time from July 26, 1979, until August 6, 1979, in which to answer the motion of the Department of Justice

( " Department") to compel production of documents which Houston maintains are privileged.

On May 24, 1979, Houston served on the Department an updated list of privileged docun.ents. Counsel for the Department and Houston disagreed as to the privileged nature of some documents, and negotiations were subsequently conducted by telephone. At

the conclusion of these discussions, Houston agreed to produce a number of additional documents. However, not all differences between the parties were resolved.

The Department now seeks the production of twenty-four additional documents which Houston has claimed are privileged.

Due largely to the extensive amount of time which counsel for Houston have recently had to devote to other aspects of dis-covery in this proceeding, Houston is unable to prepare an adequate answer to the Department's motion by July 26, 1979.

Wherefore Houston respectfully requests that the time for responding to the Department's motion be extended until August 6, 1979.
