Mooney, Senior Vice President Gulf Mineral Resources Company 1720 So. Bellaire Street Denver, Colorado 80222 RE: Discharge Plan approval for Mariano Lake Mine.

Dear Mr. Mooney:

The discharge plan (DP-44) for Gulf Mineral Resources Company's Mariano Lake Mine (located in T15N, R14W, McKinley County, N.M.) is hereby approved, provided Gulf's commitments relayed to Bruce Gallaher (EID) by Karen Rasmussen (Gulf) today by telephone are acknowledged in writing within two weeks from receipt of this letter. The approved discharge plan consists of the discharge plan dated September 1, 1978, which was received by this Division September 5, 1978, the amendment thereto dated October 19, 1978, and the above mentioned verbal commitments which are to be confinned in writing. Those commitments are:

1. Gulf will sample the proposed shallow alluvial monitor well quarterly and report the analytical results to NMEID on a quarterly basis,
2. Gulf will continue to sample the three mine water settling ponds seepage detection wells monthly and report the results to NMEID quarterly.
3. All samples collected from the ailuvial monitor well and from the seepage detection wells will be analyzed for all of the constituents tabulated in Section 3-103 of the amended New Mexico Water Quality Control Commission Regulations (NMWQCCR).
4. Until a National Pollutant Discharge Elimination System {NPDES) discharge permit becomes effective and enforceable for Mariano Lake Mine, Gulf will continue to sample any temporary treated mine water discharges at the outfall point. A composite sample of the effluent shall be collected

~nd analyzed for all of the constituents tabulated in Section 3-103 of the amended NMWQCCR. The Analytical results of this sample will be reported to NMEID upon receipt of laboratory reports.

Mooney November 22, 1978 Page 2 If Gulf cor1111ences continuous surface water discharge of treated mine water prior to the NPDES permit becoming effective and enforcea~le, Gulf shall sample the effluent monthly at the outfall point. Analysis will be perfonned on the sample(s) for the Section 3-103 constituents referenced above. Reporting to NMEID shall be quarterly.

Subsequent to the NPOES pennit becoming effective and enforceable, Gulf shall sample the effluent monthly at the outfall point. Analysis on the sample(s) will be performed for the Section 3-103 constituents excepting those constituents specified within the NPOES permit. Analyt-ical results of the sampling will be reported to NMEID on a quarterly basis.

If any of the conmitments as stated above are not accurate, or do not reflect Gulf's intent, please notify me i111nediately and consider this approval with-drawn until further notice.

The discharge plan was submitted pursuant to Section 3-106 of the New Mexico Water Quality Control Commission Regulations. It is approved pursuant to Section 3-109. Please note subsections 3-109.E and 3-109.F. which provide for possible future amendment of the plan. Please also be advised that the approval of this plan does not relieve you of liability should your operation result in actual pollution of surface or groundwaters which may be actionable under other laws and/or regulations.

The monitoring and reporting shall be as specified in the discharge plan and S;J::!:'I~ts -le! !!t:l-Pursuant to s:.msection 3-109.G.4, this plan approval is for a period of five years. This approval will expire November 21, 1983 1 and you should submit an application for new approval in ample time before that date.
