U.S. NUCLEAR REGULATORY COMMISSION AMENDMENT 1 TO SPECIAL NUCLEAR MATERIAL LICENSE 2019 FOR APPROVAL OF GLOBAL LASER ENRICHMENT GLEP-00009-R, STANDARD PRACTICE PROCEDURES PLAN, REVISION 17 (COST ACTIVITY CODE 000225/07007016/L-2018-SPR-0003)

Dear Ms. Jenny:

The U.S. Nuclear Regulatory Commission (NRC) staff has completed the review of the GLEP-00009-R, Revision 17 to the Standard Practice Procedures Plan (SPPP) for the Protection of Classified Matter for the GE-Hitachi Global Laser Enrichment, LLC Wilmington Facilities submitted via letter (GLE-2018-0047) dated, July 13, 2018 (Non-public Agencywide Documents Access and Management System [ADAMS] Accession Number ML18206A540).

This revision was submitted to include access requirements for restricted data (RD) requested by the NRC staff via letter from Brian McDermott (Director of the Office of Nuclear Security and Incident Response) dated June 8, 2018 (Non-public ADAMS Accession Number ML18068A017), and to comply with Security Executive Agent Directive (SEAD 3) directive the NRC recently extended to licensees via NRC letter, YA-18-0062 Updates to NRC Personnel Security Reporting Requirements dated July 5, 2018 (Non-public ADAMS Accession Number ML18186A658).

The NRC staff determined that General Electric-Hitachi Global Laser Enrichment, LLCs (GLEs) proposed definition of U.S. Critical Data Technology, also referred to as U.S. only developed RD, does not meet NRCs requirements for defining all classified matter that must be protected from access by foreign nationals. Therefore, the NRC staff conducted a site visit to GLE on November 5 and 6, 2018, to review the U.S. only developed RD, see meeting summary (ADAMS Accession Number ML18333A066). Based on this meeting, GLE agreed to resubmit the Standard Practice Procedure Plan (SPPP), Revision 17, (ADAMS Accession Number ML18338A283) with the definition of U.S. only developed RD removed. The GLE staff agreed to submit a definition for U.S. only developed RD as a separate classified package.

Documents transmitted herewith contain Security-Related Information. When separated from the sensitive conditions in enclosure 2, this document and enclosure 1 is decontrolled.

OFFICIAL USE ONLY - SECURITY - RELATED INFORMATION P. Jenny 2 In SPPP, Revision 17, GLE provides a commitment to implement SEAD 3 reporting requirements. The GLE staff states they will report to the NRC any adverse information coming to the companys attention concerning any cleared employees consistent with Title 10 of the Code of Federal Regulations (10 CFR), Section 25.21 and the SEAD 3. The document provides a list of the reporting criteria that GLE will follow for compliance with the SEAD 3 and commits to providing these within an appropriate timeframe.

The NRC staff has reviewed GLEs submittals as discussed above. Based on this review, the NRC staff approves the SPPP, GLEP-00009-R Revision 17. The NRC is also amending the license SNM-2019 to incorporate the most recent revisions to the SPPP, Program Cyber Security Plan and Classified Distribution Information Network. A public and non-public version of the license are enclosed.

This action closes Cost Activity Code: 000225/07007016/L-2018-SPR-0003.
