LA CROSSE BOILING WATER REACTOR - INITIAL FEDERAL REGISTER NOTICE REGARDING THE LACROSSE SOLUTIONS LICENSE TRANSFER APPLICATION AND ASSOCIATED CONFORMING ADMINISTRATIVE LICENSE AMENDMENTS TO TRANSFER LICENSE TO THE DAIRYLAND POWER COOPERATIVE (CAC NO. 000083; EPID-L-2018-LNS-0002)

Dear Mr. Sauger:

The U.S. Nuclear Regulatory Commission (NRC) has received the LaCrosseSolutions, LLC (LS) and Dairyland Power Cooperative (DPC) application dated June 27, 2018 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML18184A444), which requests NRC approval to transfer LSs Possession Only License No. DPR-45 for the La Crosse Boiling Water Reactor (LACBWR) to DPC.

Following approval of the proposed transfer of control of the license, DPC would acquire full ownership of the facility, similar to what existed before the June 1, 2016 (ADAMS Accession No. ML16123A049), license transfer to LS. The proposed amendment would reflect that LSs licensed possession, maintenance, and decommissioning authorities have been transitioned back to DPC upon completion of decommissioning activities at the LACBWR site. Thereafter, DPC will maintain the onsite independent spent fuel storage installation, and the ultimate disposition of the spent nuclear fuel will be provided for under the terms of DPCs Standard Contract for Disposal of Spent Nuclear Fuel and/or High Level Waste with the U.S. Department of Energy. DPC will also continue to maintain its nuclear decommissioning trust, a grantor trust in which funds are segregated from its assets and outside its administrative control.

The NRC staff has prepared a Federal Register Notice (FRN) related to the LS and DPC application for direct transfer of the LACBWR operating license, which summarizes the request and provides an opportunity for members of the public and other stakeholders to submit comments, request a hearing, and petition for leave to intervene.
