) 50-401 (Shearon Harris Nuclear Power ) '0-402 Plant, Unit's 1, '2, 3 and 4) ) 50-403 APPLICANT'S RESPONSE TO POSTCARD REQUEST OF KUDZU ALLIANCE AND WELLS EDDLEMAN In ALAB-526, 9 NRC (February 13, 1979), this Appeal Board affirmed the January 10, 1979 Order of the Licensing Board denying a series of petitions by the Kudzu Alliance and Mr. Wells Eddleman for "general intervention" status in the captioned proceeding and specifically for intervention in the remanded proceeding on management capability.
On March 13, 1979, a postcard communication to this Appeal Board from Mr. Eddleman Wps docketed. The communication states: "In light of the ASLB's apparent willingness now to reverse it,s initial ruling on Kudzu Alliance's and my intervention in the Safe Mgt hearings, we ask the Appeal Board to return that issue .to .the ASLB for a ruling." This cryptic comment may be misleading.
0 The Licensing Board did not reverse or indicate "willingness" to reverse its initial ruling on the intervention of Mr. Eddleman and the Kudzu Alliance.
At the remanded proceeding held in Raleigh, North Carolina on February 27 through March 2 and March 6 through March 8, 1979, Mr. Eddleman-was permitted to make an oral limited appearance statement. Tr. 2381-2403; 2531-2535. Further, the Licensing Board permitted Mr. Eddleman to sit at counsel table with the Intervenors and the counsel from the North Carolina Attorney General's office to participate in the hearing as an advisor to those attorneys. Tr. 2405, 2406.
In granting Mr. Eddleman the right to participate in the remanded hearing in this limited manner, the Board did not, find that either Mr. Eddleman or the Kudzu Alliance now could make the showing required by the rules for intervention in a proceeding. In fact, the Board indicated that it could not allow Mr. Eddleman to participate as a fu'll intervenor because it had no "right to suspend 5 2.714, the Intervention Rules." Tr. 2405. A copy of the transcript whereby the Board granted Mr. Eddleman this right of limited participation is attached hereto.
Mr. Eddleman has brought no new information to the attention of the Appeal Board that would warrant reconsideration of its decision in ALAB-526,or,remand to the Licensing Board on the question of intervention. Absent review by the Commission (for which neither Mr. Eddleman nor the Kudzu Alliance petitioned

the Order of the Atomic Safety and Licensing Board, as affirmed by the Appeal Board, is final. 10 C.F.R. 5 2.786.
