Dear Mr. Bjornsen,

The Fish and Wildlife Service (Service) provided a March 7, 2014 Concurrence Letter, to the Army Corps of Engineers (ACOE) (see attached), in response to a ACOE November 20, 2013 letter requesting consultation with the Service on this project. Our records indicate the ACQE issued a permit (File Number 201 3-00329N), to a Mr Mark Smith with PG&E, Eureka, CA on July 23, 2014, "...to conduct work and discharge fill in waters of the U.S. associated with a remediation project in support of decommissioning and license termination for it's former nuclear power generation facility (known as Unit 3) at the 143-acre Humboldt Bay Power Plant (HBPP)."

The Service concluded that consultation on this project has been completed, unless re-initiation is necessary.

Humboldt Bay Power Plant (HBPP) Unit 3 License Termination Plan (LTP)

PG&E has submitted a license amendment to the NRC for a plan to terminate the operating license for HBPP Unit 3. NRC staff are currently working to develop the technical (safety) aspects of the license amendment, as well as preparing the environmental assessment (EA). To complete the EA (under NEPA), consultation under Section 7 of the Endangered Species Act (ESA) must take place.

On april 17, 2014 a letter was sent to Nancy Finley, stating that according to NRC staff, based upon a number of biological assessments of the HBPP 143-acre site, a preliminary determination of No Adverse Effect on listed species or essential fish habitat would occur from the activities associated with the LTP. An assessment was attached to the letter.

Since no response was received from the Arcata Office regarding concurrence or the need for consultation, was there something that was missing or that needs to be changed?

The Army Corps of Engineers (ACOE), who is permitting the remediation of the intake and discharge canals submitted a letter initiating formal consultation pursuant to ESA Section 7. Contained in the permit application are not only aquatic species, but terrestrial species, as well.

Is there anything more that the NRC needs to do to complete an informal consultation?
