C.1 Application Format & Content
- 8. PART 8 - License Conditions; Inspections, Tests, Analyses, & Acceptance Criteria The applicants proposed inspections, tests, analyses, and acceptance criteria (ITAAC) and the proposed license conditions, if any, comprise Part 8 of the application under 10 CFR Part 52.
The requirements for ITAAC pertaining to an application for a Combined License (COL),
standard design certification (DC), and early site permit (ESP) are set forth, respectively, at
§52.80(a), §52.47(b)(1), and §52.17(b)(3). Applicant guidance pertaining to ITAAC development and format is provided in Section C.2 of this regulatory guide under the title Inspections, Tests, Analyses, and Acceptance Criteria.
ITAAC A COL application shall include the proposed inspections, tests, and analyses, including those applicable to emergency planning, that the licensee shall perform, and the acceptance criteria that are necessary and sufficient to provide reasonable assurance that, if the inspections, tests, and analyses are performed and the acceptance criteria met, the facility has been constructed and will be operated in conformity with the combined license, the provisions of the Act, and the Commission's rules and regulations [§52.80(a)]. The COL applicant should provide the proposed selection methodology and criteria for establishing ITAAC in Section 14.3 of the final safety analysis report (see guidance in Appendix A to this regulatory guide) and include the proposed ITAAC in Part 8 of the COL application.
A DC application shall include the proposed inspections, tests, analyses, and acceptance criteria that are necessary and sufficient to provide reasonable assurance that, if the inspections, tests, and analyses are performed and the acceptance criteria met, a facility that incorporates the design certification has been constructed and will be operated in conformity with the design certification, the provisions of the Act, and the Commission's rules and regulations [§52.47(b)(1)]. DC applicants using the document hierarchy convention of Tier 1 and Tier 2 should include ITAAC in the Tier 1 information. Tier 1 is the portion of the design-related information included within the DC rule, and Tier 2 is the portion of the design-related information that is approved but not certified in the DC rule.
For an ESP application that does not request a limited work authorization, the ITAAC requirements are limited to emergency planning. Pursuant to §52.17(b)(3), the ESP applicant has three alternatives: 1) emergency planning ITAAC shall be included if the application contains proposed complete and integrated emergency plans [§52.17(b)(2)(ii)]; 2) emergency planning ITAAC may be included (i.e., optional) if the application contains the proposed major features of the emergency plans [§52.17(b)(2)(i)]; and, 3) emergency planning ITAAC are not applicable if the application content is limited to addressing physical site characteristics that could pose significant impediments to the development of emergency plans [§52.17(b)(1)].

ITAAC other than those pertaining to emergency planning or to a limited work authorization (if one is requested) are not applicable to an ESP application.
License Conditions A combined license issued under Part 52 is subject to a number of regulatory conditions. For example, §50.54, Conditions of Licenses, identifies conditions applicable to every combined license, some of which are applicable after the Commission has made the finding under
§52.103(g), and §50.55, Conditions of Construction Permits, Early Site Permits, Combined Licenses, and Manufacturing Licenses, identifies conditions applicable to every combined license until the date of the Commission finding under §52.103(g). A COL applicant may propose license-specific additional conditions in coordination with the NRC staff review of the application. Part 8 of the application is the appropriate location to document license-specific conditions.
An early site permit issued under Part 52 is subject to certain regulatory conditions; §50.55 identifies conditions applicable to each early site permit. An ESP applicant may propose permit-specific additional conditions in coordination with the NRC staff review of the application.
