7. PART 7 - Exemptions, Departures, and Variances The exemptions, departures and/or variances applicable to a specific application comprise Part 7 of the application under 10 CFR Part 52. Exemptions from Part 52 are addressed in

§52.7, Specific Exemptions, §52.63, Finality of standard design certifications, §52.93, Exemptions and variances, and the design certification rule appendices to Part 52.

Departures are addressed in §52.63, Finality of standard design certifications and the design certification rule appendices to Part 52. Variances are addressed in §52.39, Finality of early site permit determinations and §52.93, Exemptions and variances.

Exemptions: An applicant for a combined license (COL), design certification (DC) or early site permit (ESP) may request an exemption from one or more of the requirements of Part 52 as provided in §52.7. Exemptions from the requirements of other parts of the regulations, applicable by virtue of Part 52, are governed by the exemption requirements of those parts.

Departures: A COL applicant referencing a DC may make departures from the design as provided in §52.63, §52.93 and Section VIII, Processes for Changes and Departures, of the referenced DC rule appendix to Part 52.

Variances: A COL applicant referencing an ESP may request a variance from the permit or the site safety analysis report as provided in §52.39 and §52.93.

Guidance pertaining to departures and variances for a COL applicant referencing a DC and/or ESP is provided in Section C.2 of this regulatory guide.

Part 7 of the application should include the following:

1) A table listing the identifying number, title, and brief description of each requested exemption, departure, and variance
2) Information for each exemption, departure, and variance to include:

a) The scope and summary of the request; b) Justification relative to the specific application with cross-references to applicable regulatory guidance and/or requirements; c) A technical and regulatory evaluation relative to safety significance and regulatory acceptance criteria (e.g., 50.12,Section VIII of referenced DC rule); and d) For departures, a statement identifying the need for NRC approval or need for an exemption.
