3. PART 3 - Environmental Report The environmental report comprises Part 3 of the application under 10 CFR Part 52.

Requirements for the environmental report pertaining to combined license (COL), early site permit (ESP), and standard design certification (DC) applications are set forth, respectively, in

§52.80(b), §52.17(a)(2), and §52.47(b)(2), which reference the applicable sections of 10 CFR Part 51, Environmental Protection Regulations for Domestic Licensing and Related Regulatory Functions.

The scope and content of the environmental report varies by the type of application. A COL application includes the "Applicant's Environmental Report-Combined License Stage" which contains information in accordance with §51.50(c) or, if a limited work authorization is requested, in accordance with both §51.49(a) and §51.50(c). An ESP application includes the "Applicant's Environmental ReportEarly Site Permit Stage" which contains information in accordance with §51.50(b) or, if a limited work authorization is requested, in accordance with both §51.49(c) and §51.50(b). A DC application includes the "Applicant's Environmental ReportStandard Design Certification" which contains information in accordance with §51.55.

Further, a COL application referencing an ESP may incorporate by reference the issues resolved in the environmental impact statement prepared by the NRC for the ESP; and, a COL application referencing a DC may incorporate by reference the issues resolved in the environmental assessment prepared by the NRC for the referenced design certification.1 Guidance for the format and content of environmental reports is provided in Regulatory Guide (RG) 4.2, Preparation of Environmental Reports for Nuclear Power Stations, Revision 2, July 1976. The applicant should use the most recent version of the RG, but may use the version in place 6 months prior to the date of tendering of the application.

Guidance to the NRC staff for review of environmental reports is provided in NUREG-1555, Standard Review Plans for Environmental Reviews for Nuclear Power Plants: Environmental Standard Review Plan.

In addition, current interim staff guidance addresses the NRC staff review of environmental reports. COL/ESP-ISG-026, Environmental Issues Associated with New Reactors, August 2013 (ML12326A742), is applicable to the review of all ESP and COL applications to include those applicants requesting an LWA. COL/ESP-ISG-027, Specific Environmental Guidance for iPWR Reviews, August 2013 (ML12342A228), provides supplemental guidance to the staff for conducting environmental reviews in areas unique to small modular reactor application 1 The finality of environmental issues for a COL application referencing an ESP and/or DC is addressed in this regulatory guide in Section C.2, Finality of Environmental Issues for COL Referencing ESP and/or DC.
