• - eaSe m All, NRR and R-11 held a conference call with Duke on February 9, 2011, to discuss the licensee's plans regarding the level of detail that they intend to provide in their April 2011 letter, regarding final repairs to address the external flooding issue at the Oconee site. I was encouraged by the level of support from Duke on the call, including Bill Pitesa and Preston Gillespie, as well as several members of their engineering support team.

Meena Khanna was kind enough to put together a few highlights from the call for me, and I wanted to share them with you for your awareness. I'll keep you posted, as we continue to work with R-11 to bring the external flooding issue to closure. Please let me know if you have any questions or comments.

Summary of February 9, 2011, Teleconference with Duke Energy Concerning External Flooding issues at Oconee Nuclear Station

" Duke agreed to incorporate a sunny day failure of the Jocassee Dam in its licensing basis, and indicated that it will be included in theOconee final safety analysis report.

• Duke indicated that their April 3 0 th submittal will provide a summary of its mitigation approach and descriptions of the final plant modifications that will implement the mitigation approach. The licensee indicated that the level of detail will be that of a UFSAR description.

• Duke noted that the biggest challenge to meeting the CAL's November 2011 deadline to complete plant modifications to address external flooding, will be the permanent modification to the intake dike that requires approval by FERC.

• Duke indicated that they plan to make the design change packages and supporting calculations available for the Region II inspectors. They will screen the modifications in accordance with 50.59 and their modification process to ensure that those modifications do not negatively impact other structures, systems, and components (SSCs). Duke also stated that they would address two areas for which the staff has questions: 1) flow velocities and material transport issues with regards to impact on the SSCs; and 2) defense in depth.

• Duke was not in a position to commit to a final schedule for the implementation of the final repairs at this time. However, Rich Freudenburger indicated that their goal is to have all of the final repairs implemented by November 2011, except for perhaps the permanent solution for the temporary structure on the intake dike structure. Duke indicated that they plan to keep their ICMs in place until implementation of the final repair; however, they mentioned they may ask to stop the ICMs when all the plant modifications are done (with the possible exception of the permanent solution for the intake dike wall). NRR agreed to discuss this.issue further with Duke, once Duke provides the schedule for completing all of the final repairs.

" Both parties agreed to have further discussions and periodic calls, as Duke continues to finalize its mitigation strategy and schedule. Duke will contact the NRR Project Manager to set up another conference call with the staff in the next few weeks.

" Both Bill Pitesa and Preston Gillespie participated in the call, and indicated that they recognize they have a challenge in dealing with several issues at the ONS site; however, they reiterated the importance of addressing the external flooding issue in a timely manner, and stated that their goal is still to meet the November 2011 deadline, and they are working to that end.
