Change in Estimated Review Schedule and Level of Effort for Oconee Nuclear Station Proposed Alternative to Use Code Case N-752 (EPID L-2022-LLR-0060)

Date: Friday, May 5, 2023 11:37:50 AM Mr. Treadway, By letter dated July 27, 2022 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML22208A031), as supplemented on March 9, 2023 (ML23068A015), Duke Energy Carolinas, LLC, (Duke Energy) submitted an alternative request for Oconee Nuclear Station, Units 1, 2, and 3, and the Keowee Hydro Station, Units 1 and 2. Specifically, Duke Energy is requesting to use the alternative requirements of ASME Code Case N-752, Risk-Informed Categorization and Treatment for Repair/Replacement Activities in Class 2 and 3 SystemsSection XI, Division 1, for determining the risk-informed categorization and for implementing alternative treatment for repair/replacement activities on moderate and high energy Class 2 and 3 items in lieu of certain ASME Code Section XI, paragraph IWA-1000, IWA-4000, and IWA-6000 requirements. On August 23, 2022 (ML22235A655), the NRC staff notified you that your alternative request had been accepted for review and estimated a completion date by May 26, 2023, and 190 NRC staff hours to complete.

During recent routine interactions between myself and my Oconee Duke Energy licensing contact, Mr. Jordan Vaughan, I informed him of the potential delay and reasons for the change in the schedule. The purpose of this email is to officially inform you that the NRC will not complete its review by May 26, 2023, due to additional time NRC staff needs to evaluate new information regarding the possibility that performing a risk-informed categorization under Code Case N-752 and under 10 CFR 50.69, Risk-informed categorization and treatment of structures, systems and components for nuclear power reactors, could result in different categorizations.

The NRC staff now estimates that this licensing request may take up to 290 NRC staff hours to complete and expects to complete its review by August 22, 2023. These estimates could change due to several factors such as requests for additional information and an unanticipated addition of scope to the review. If there are emergent complexities or challenges in our review that would result in a change to the estimated completion date or significant changes in the estimated hours, the reasons for the change, and a revised estimate will be communicated during routine interactions with the assigned project manager.

The change in the estimated completion date and estimated hours was approved by the Deputy Director for the Division of Operating Reactor Licensing.
