SUBJECT:

DAIRYLAND POWER COOPERATIVE, LA CROSSE BOILING WATER REACTOR - TERMINATION OF ORDER FOR IMPLEMENTATION OF ADDITIONAL SECURITY MEASURES ASSOCIATED WITH ACCESS AUTHORIZATION, FITNESS FOR DUTY AND BEHAVIOR OBSERVATION (EA-03-099)

Dear Mr. Berg:

On August 18, 2004, the U.S. Nuclear Regulatory Commission (NRC) issued an Order for Implementation of Additional Security Measures Associated with Access Authorization, Fitness for Duty and Behavior Observation to Dairyland Power Cooperative (DPC) for LaCrosse Boiling Water Reactor. This Order applied to decommissioning nuclear power plants with spent fuel in the spent fuel pool. By correspondence dated September 19, 2012, as supplemented October 24, 2012, you have reported that all fuel has been removed from the spent fuel pool and have requested that the Order be rescinded. Since, by its terms, the Order applies only to decommissioning power reactor licensees with spent fuel in the spent fuel pool, I find good cause to grant your request and I hereby rescind the Order as provided in Section III of the Order. Consistent with your October 24, 2012, letter, DPC shall immediately reinstate compliance with the requirements of this Order should spent fuel need to be returned to the spent fuel pool. In all other respects, DPC shall continue to adhere to the terms and conditions of the LaCrosse Boiling Water Reactor, Independent Spent Fuel Storage Installation license and the Commission's regulations.
