ANNUAL ASSESSMENT LETTER FOR DAVIS-BESSE NUCLEAR POWER STATION, UNIT 1 (REPORT 05000346/2011001)

Dear Mr. Allen:

On February 17, 2011, the NRC completed its end-of-cycle performance review of the Davis-Besse Nuclear Power Station. The NRC reviewed the most recent quarterly performance indicators (PIs) in addition to inspection results and enforcement actions from January 1, 2010, through December 31, 2010. This letter informs you of the NRCs assessment of your facility during this period and its plans for future inspections at your facility. This performance review and enclosed inspection plan do not include security information. A separate letter will include the NRCs assessment of your performance in the Security Cornerstone and its security-related inspection plan.

The NRC determined that overall, Davis-Besse Nuclear Power Station, Unit 1, operated in a manner that preserved public health and safety and met all cornerstone objectives. Plant performance for Davis-Besse Nuclear Power Station, Unit 1, was in the Regulatory Response Column of the NRCs Reactor Oversight Process (ROP) Action Matrix for the first three quarters of the assessment period due to a White inspection finding that was issued on December 28, 2009. The finding was closed in a letter dated December 28, 2010. The NRC determined that performance for the Davis-Besse Nuclear Power Station, Unit 1, during the fourth quarter of the assessment period was within the Licensee Response Column because all inspection findings had very low (i.e. green) safety significance, and all PIs indicated that your performance was within the nominal, expected range (i.e. green). As a result, the NRC plans to conduct ROP baseline inspections at your facility. In addition to the ROP baseline, inspections are planned for Temporary Instruction (TI) 2515/179, Verification of Licensee Responses to NRC Requirement for Inventories of Materials Tracked in NSTS, TI 2515/177, Managing Gas Accumulation in Emergency Core Cooling, Decay Heat Removal, and Containment Spray Systems, Inspection Procedure (IP) 71007, Reactor Vessel Head Replacement Inspection, and IP 92702, Followup on Corrective Actions for Violations and Deviations."

The NRC identified a cross-cutting theme in the Work Practices component of the Human Performance cross-cutting area. Specifically, four findings were identified with the cross-cutting aspect of work oversight (H.4(c)). The NRC determined that a substantive cross-cutting issue does not exist because the NRC does not have a concern with your staffs scope of effort and progress in addressing the cross-cutting theme. Three of the findings were related to repair activities as a result of the identification of reactor vessel head nozzle penetration cracking. Specifically, the findings were attributed to work conducted by contractor staff. Based on our review of your actions to address this theme, we determined that you recognized the cross-cutting theme and have completed an Apparent Cause Evaluation. Your planned and implemented corrective actions address the oversight circumstances that led to the cross-cutting theme and are expected to be effective. The NRC will continue to monitor your staffs efforts and continued progress in addressing the theme.

The enclosed inspection plan lists the inspections scheduled through June 30, 2012.

Routine inspections performed by resident inspectors are not included in the inspection plan.

The inspections listed during the last 9 months of the inspection plan are tentative and may be revised at the mid-cycle performance review. The NRC provides the inspection plan to allow for the resolution of any scheduling conflicts and personnel availability issues. The NRC will contact you as soon as possible to discuss changes to the inspection plan should circumstances warrant any changes.
