NRC EVALUATION OF YOUR ACTIONS IN RESPONSE TO AN NRC CONFIRMATORY ORDER, DATED DECEMBER 1, 2009

Dear Mr. Kuhn:

The purpose of this letter is to: (1) acknowledge receipt of your undated letter, received by the NRC Region I office on March 25, 2010, which described the actions you had taken as required by the Confirmatory Order issued to you by the NRC on December 1, 2009; and, (2) document the results of the NRC evaluation of your actions.

The NRC Confirmatory Order (ADAMS Accession No. ML0933501341) required that you author an article in which you related your failure to timely report an arrest to Exelon Generation Company (Exelon) in accordance with site procedures, while you were employed as a Reactor Operator at Exelons Peach Bottom facility. The Confirmatory Order also required that the article describe what you learned from the incident, as well as emphasize the importance of adherence to all requirements, including the requirement of informing facility licensees of all reportable incidents defined within the facilitys behavior observation program. The Confirmatory Order further required that you submit the article to: (1) Exelon, for consideration to use in its training program; and, (2) the Professional Reactor Operator Society (PROS) and the Institute of Nuclear Power Operations (INPO), requesting their consideration for publication in their respective newsletters. You were to complete these actions within 90 days of the date of the Confirmatory Order, and then send a letter to the NRC, attaching a copy of the article, within 30 days of having completed those actions.

Your undated letter (ML101130526) attached a copy of an article you wrote which met the expectations set forth in the Confirmatory Order. Your letter also indicated that copies of the article were sent to PROS and INPO for publication consideration, and to Exelon, for consideration to use in its training program. NRC Region I contacted Exelon, PROS, and INPO, and confirmed that they have all received your article. Therefore, we have determined that you have satisfied all the terms of the Confirmatory Order.
