OF THE JULY 30, 2009, CATEGORY 2 PUBLIC MEETING BETWEEN THE U.S. NUCLEAR REGULATORY COMMISSION AND INDUSTRY REPRESENTATIVES REGARDING THE NRCS TOPICAL REPORT PROCESS (TAC NO. MD4832)

On July 30, 2009, a Category 2 public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) staff and industry representatives at NRC headquarters to discuss issues regarding Topical Report (TR) process improvements. A list of meeting attendees is enclosed and the meeting agenda is contained in the July 30, 2009, public meeting notice available in the Agencywide Documents Access and Management System (ADAMS) as Accession No. ML091770196.

In summary, the NRC staff and industry representatives provided updates and exchanged perspectives on the following:

A.

The current status of LIC-500, Draft Revision 4 B.

Pre-submittal meetings C.

Implementation of the draft TR prioritization scheme D.

TR issues for future resolution E.

Future monthly TR public meetings Opening remarks were provided by Ms. Stacey Rosenberg, Branch Chief, Special Projects Branch, Division of Policy and Rulemaking (DPR), Office of Nuclear Reactor Regulation (NRR).

Ms. Rosenberg thanked the NRC staff and industry representatives for its continued support of the monthly TR meetings. Going forward, Ms. Rosenberg emphasized that the meetings have been useful to the NRC staff and that the NRC was prepared to move forward with the TR prioritization scheme.

S. Rosenberg To open the meeting, Ms. Tanya Mensah, Senior Project Manager, recapped a discussion that occurred during the April 23, 2009, public meeting, regarding pre-submittal TR meetings. To summarize, industry representatives asked that the TR Team consider, for first-of-a-kind/complex TRs, that more than one non-fee billable meeting may be needed to support conceptual development of the TR and planning. After the meeting, Ms. Mensah followed up with the Office of Chief Financial Officer (OCFO) to obtain feedback on this issue. As communicated during the July 30, 2009, public meeting, the OCFO representative, Ms. Rebecca Erickson, provided feedback to NRR in early July 2009, that all pre-submittal meetings to support TR reviews should be fee-billable, in accordance with Title 10 of the Code of Federal Regulations (10 CFR) Section 170.11.

Overall, it was the agreement of both the NRC staff and industry representatives that the pre-submittal meetings have been valuable, and that they should continue in the future.

However, industry representatives expressed that clarifying guidance should be provided by the NRC in a Regulatory Issue Summary, or some other type of generic guidance. The TR Team agreed to take this recommendation back to the NRR management for additional discussion.

In addition, industry representatives asked the TR Team if they could obtain feedback regarding how pre-submittal meetings in support of license amendments are currently billed.

Ms. Rosenberg took the action to follow up on this item.

After this discussion, Ms. Mensah provided an update to the industry representatives on the near-term priorities that were assigned to DPR. To summarize:

  1. 1: DPR should continue its current progress on TR reviews, including its current assessment of LIC-500 by May 30, 2009.

o Current Status: Complete. LIC-500 is in concurrence.

  1. 2: DPR should develop a prioritization/valuation scheme for TRs, including consideration of internal and external views. A draft prioritization scheme developed with implementation plan and presented to the NRR Leadership Team (LT) by May 30, 2009.

o Current Status: Complete. The revised LIC-500 incorporates guidance to support implementation of the prioritization scheme. As discussed during the July 30, 2009, public meeting, industry representatives are now expected to include and address the prioritization factors on the cover memo of each incoming TR. Appendix C, Draft Prioritization Scheme, of LIC-500 was provided during the public meeting (ADAMS Accession No. ML092190887).

  1. 3: DPR to reassess TR metrics for timeliness and resource expenditures, based on the new prioritization/valuation scheme. Provide results of metrics assessment to NRR LT for the first and second quarters following prioritization scheme implementation, but no later than January 30, 2010.

o Current Status: In progress. The TR Team will track data for TRs that are prioritized within each branch. The information that will be tracked to form

S. Rosenberg a basis for reassessing the TR metrics will be discussed internally in more detail.

  1. 4: DPR should establish a process for the assignment of a Technical Champion for the more technically challenging TRs. Include attributes for decision to have a Technical Champion in LIC-500 procedure by May 30, 2009.

o Current Status: Complete. The technical champion process has been integrated into the revised LIC-500.

After discussion of the near-term TR priorities, the industry representatives discussed the following issues:

Pilot License Amendment Requests In Conjunction With TR Reviews Industry representatives asked if the TR Team could provide an update at the next TR public meeting regarding the next steps to support development of a process which would permit the review of a TR, in parallel with the review of a pilot license amendment request (i.e., a pilot plant). The NRC TR Team took an action to provide an update/status during the next public meeting.

Development Of A Process Similar to 10 CFR 50.59 For Screening/Evaluation Changes To Approved TRs Industry representatives plan to propose an approach during a future TR public meeting, to support the development of a process (similar to 10 CFR 50.59) which would allow vendors to modify an NRC-approved TR for changes that are not significant, without obtaining NRC approval. The NRC TR Team provided feedback that when that discussion occurs, it will require the involvement of the NRCs legal, policy, and technical experts to discuss and evaluate the industry proposal.

TR Metrics Compared to LAR Metrics Industry representatives discussed their future efforts to re-evaluate their own TR metrics. They expressed that the NRC metrics for TRs and license amendment requests should also be identical. The NRC TR Team stated that based upon the data collected as a result of the draft prioritization, the NRC may have justification to support changes to the current metrics (Yellow Ticket Item #3).

Lessons Learned From TR Reviews on LIC-500 The Pressurized Water Reactor Owners Group (PWROG) provided a couple of examples of TRs that experienced significant delays during the acceptance review phase. The industry representatives and NRC staff discussed the lessons learned from the examples provided by the PWROG. In addition, the NRC TR Team identified that in the future, if the staff can not complete the acceptance review in 60-days, that the TR would be prioritized in accordance with the TR prioritization scheme.

Ensuring that the linkage between 10 CFR Part 52 and Part 50 for the TR process are consistent.

Path forward to ensure that incoming TRs are captured in ADAMS by the NRC Document Control Desk in a timely manner.
