OF THE NOVEMBER 19, 2009, CATEGORY 2 PUBLIC MEETING BETWEEN THE U.S. NUCLEAR REGULATORY COMMISSION AND INDUSTRY REPRESENTATIVES REGARDING THE NRCS TOPICAL REPORT PROCESS (TAC NO. MD4832)

On November 19, 2009, a Category 2 public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) staff and industry representatives at NRC headquarters to discuss issues regarding Topical Report (TR) process improvements. A list of meeting attendees is enclosed and the meeting agenda is contained in the October 22, 2009, public meeting notice available in the Agencywide Documents Access and Management System (ADAMS) as Accession No. ML092880784.

In summary, the NRC staff and industry representatives provided updates and exchanged perspectives on the following:

Revising completed TR reviews E.

Future monthly TR public meetings Opening remarks were provided by Ms. Stacey Rosenberg, Branch Chief, Special Projects Branch, Division of Policy and Rulemaking (DPR), Office of Nuclear Reactor Regulation (NRR).

Ms. Rosenberg thanked the NRC staff and industry representatives for its continued support of the monthly TR meetings.

S. Rosenberg To open the meeting, Ms. Tanya Mensah, Senior Project Manager, provided an update to the industry representatives on the near-term priorities that were assigned to DPR. To summarize:

  1. 1: DPR should continue its current progress on TR reviews, including its current assessment of LIC-500 by May 30, 2009.

o Current Status: Complete. LIC-500, Revision 4, was still in concurrence at the time this public meeting occurred. At the time of issuance of this meeting summary, LIC-500, Revision 4, was issued by the NRC and is available to the public (ADAMS Accession No. ML091520370). Copies of LIC-500, Revision 4, will be made available to attendees at the next TR public meeting.

  1. 2: DPR to reassess TR metrics for timeliness and resource expenditures, based on the new prioritization/valuation scheme. Provide results of metrics assessment to NRR LT for the first and second quarters following prioritization scheme implementation, but no later than January 30, 2010.

o Current Status: In progress. The TR Team will track data for TRs that are prioritized within each branch. The information that will be tracked to form a basis for reassessing the TR metrics will be discussed internally in more detail.

After discussion of the near-term TR priorities, Ms. Mensah provided a discussion on the following issues:

NRC Request For Planned TR Submittals Ms. Mensah informed the industry representatives that as part of its ongoing efforts to improve the effectiveness and efficiency of the TR program, the NRC was seeking up-to-date information on future TR submittals for planning and budgeting purposes by December 24, 2009.

Ms. Rosenberg stated that this information would be requested in writing and that the NRC was specifically seeking a list of planned TR submittals for Fiscal Year (FY) 2010, FY2011, and FY2012 (if available), including those that will be submitted for NRC staff review, those that will be submitted for information only, and if they contain proprietary information.

Advisory Committee on Reactor Safeguards Interest In TRs Industry representatives have previously raised concerns with the timing of ACRS-requested briefings for TRs currently under NRC staff review. Since some of the ACRS briefings for TRs were requested during the latter part of the NRC staffs review, the industry representatives expressed concerns that the briefings to the ACRS could impact the NRC staffs ability to issue a draft safety evaluation on schedule.

Ms. Mensah provided feedback during the meeting that LIC-500, Revision 4, has been revised to provide additional guidance to inform the ACRS of incoming TRs. The goal for the revision in LIC-500 is to support any requests for ACRS briefings earlier in the TR review.

S. Rosenberg Revisiting Completed TR Reviews As a topic for future consideration, the NRC staff discussed a need to develop a process to revisit completed TR reviews. Specifically, there have been several concerns raised within NRR and the Office of New Reactors, regarding the process that should be used by the staff to revisit the technical basis in completed TR reviews, when new technical or policy information is developed. Ms. Rosenberg stated that a process needs to be developed for incorporation into a future revision of LIC-500. The NRC staff, when ready, will provide a discussion of any NRC staff proposals during a future TR public meeting.

Pilot license amendment requests in conjunction with TR reviews Industry representatives asked for an update regarding the NRCs development of a process to support pilot license amendments in conjunction with TR reviews. Ms. Mensah provided feedback during the public meeting that the NRC was not prepared to proceed with developing this process until LIC-500, Revision 4, was issued.

Industry representatives provided a discussion of the following topics:

CLIIP-like process for TRs Industry representatives expressed interest in developing a CLIIP-like process that could be applied to TRs. They proposed to develop a future presentation describing this concept in more detail for NRC staff consideration.

Impact of NRC staff turnover Industry representatives expressed concern with the frequency of NRC staff turnover due to promotions, retirements, etc. They proposed that more monitoring is needed within the NRC to determine the impacts that NRC staff turnover has on the budget and on workload (i.e.,

schedule delays).

NRC Metrics Industry representatives discussed their future efforts to re-evaluate their own TR metrics. They expressed that the NRC metrics for TRs and license amendment requests should also be identical. The NRC TR Team stated that based upon the data collected as a result of the draft prioritization, the NRC may have justification to support changes to the current metrics (Yellow Ticket Item #3).

Standard TR Format In August 2009, the Pressurized Water Reactor Owners Group (PWROG) proposed a new TR format, WCAP-17100-P, Revision 0, "PRA Model for the Westinghouse Shut Down Seal." In TR WCAP-17100, the PWROG developed a TR format that was similar to the sections that currently appear in NRC safety evaluations. The goal of the PWROG was to take the first step towards standardizing the format that industry currently uses when submitting a TR. The PWROG asked if the NRC TR Team could obtain feedback from the technical leads who are reviewing

S. Rosenberg TR WCAP-17100 to determine if they found the new format useful. The TR Team will provide this input either prior to or during the next public meeting.

Future Public Meetings:

A public meeting date was not proposed during the meeting. Once a date has been confirmed, a meeting notice will be issued with additional detail.
