FEDERAL EMERGENCY MANAGEMENT AGENCYS RECLASSIFICATION OF AN OFFSITE DEFICIENCY IDENTIFIED DURING THE APRIL 7, 2009, EXERCISE, AS AN AREA REQUIRING CORRECTIVE ACTION

Dear Mr. Flores:

Enclosed is a copy of the Federal Emergency Management Agencys (FEMA) Region VIs letter to Mr. Jack Colley, Chief, Governors Division of Emergency Management, and Dr. David L.

Lakey, Texas Department of State Health Services, dated May 4, 2009. This letter discusses the Federal Emergency Management Agencys reevaluation of an exercise deficiency identified during the FEMA evaluation of the April 7, 2009, biennial emergency preparedness exercise at Comanche Peak Steam Electric Station. Specifically, the deficiency was that Hood County, Texas, simulated transmitting an Emergency Alert System message containing protective action instructions for the public prior to making and implementing the decision to sound offsite alert and notification system warning sirens.

The purpose of this letter is to communicate FEMAs decision to recharacterize the performance issue as an Area Requiring Corrective Action. The NRC encourages Comanche Peak Station to continue to work with appropriate offsite governmental agencies to ensure this issue is resolved by the 2011 biennial exercise. No response to the Nuclear Regulatory Commission is required.

In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter and its enclosure will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs document system (ADAMS).
