OF TELEPHONE CONFERENCE CALL HELD ON NOVEMBER 3, 2008, BETWEEN THE U.S. NUCLEAR REGULATORY COMMISSION AND ENTERGY OPERATIONS, INC. CONCERNING REQUEST FOR EXTENSION OF DISCRETION FOR THE INTERIM ENFORCEMENT POLICY FOR FIRE PROTECTION ISSUES ON 10 CFR 50.48(C), NATIONAL FIRE PROTECTION ASSOCIATION STANDARD NFPA 805 (TAC NO. ME0072)
The U.S. Nuclear Regulatory Commission (NRC or the staff) and representatives of Entergy Operations, Inc. (Entergy) held a telephone conference call on November 3, 2008, to discuss their request for extension of discretion for the interim enforcement policy for fire protection issues on 10 CFR 50.48(c), National Fire Protection Association standard NFPA 805 for Arkansas Nuclear One (ANO) , Units 1 and 2, Palisades Nuclear Plant, and Waterford 3 Steam Electric Station, submitted by Entergy on August 28,2008, Agencywide Documents Access and Management System (ADAMS) Accession number ML082540402.
In the above letter Entergy stated their plans to submit the License Amendment Request (LAR) on the following staggered schedule for the sites:
ANO-2 6 Months after the Safety Evaluation is issued for the second pilot plant Waterford 3 9 Months after the Safety Evaluation is issued for the second pilot plant ANO-1 12 Months after the Safety Evaluation is issued for the second pilot plant Palisades 19 Months after the Safety Evaluation is issued for the second pilot plant Although the call was more specific to Palisades, the general information conveyed was also applicable to Arkansas Nuclear One, Units 1 and 2, and Waterford 3 Steam Electric Station.
The NRC staff requested discussion on the following items with Palisades:
- 1. Any additional progress or information that may be available in regard to their request for extension of enforcement discretion. Specifically, what additional actions have been completed since the letter was submitted in August.
- 2. The basis for their request to extend enforcement discretion for 19 months after the second pilot plant review is complete.
The NRC staff emphasized to Palisades that the period for extension is limited to 6 months only in accordance with the Federal Register Notice (73 FR 52705) issued on September 10, 2008 and therefore any request beyond 6 months will not be granted. The licensee stated that their schedule for 19 months was based on their understanding of an earlier date for issuance of the
-2 Safety Evaluation for the second pilot plan. Palisades is working towards a completion date of October 2010 for submitting a LAR. Each of the licensees however agreed that they clearly understand the intent of the above Federal Register Notice.
With regards to progress made at Palisades, the licensee will provide an update which shows approximate percent complete for each topic. However, they stated that since the conversion process is integrated with all other plans, it is difficult to show the progress against the NEI template. The licensee will provide a docketed, detailed list of progress made for the NRC staff review and evaluation. Enclosure 1 provides the list of attendees during the teleconference.
