MEETING SUMMARIES: 1.) CATEGORY 1 PUBLIC MEETING WITH TENNESSEE VALLEY AUTHORITY (TVA) RE. BROWNS FERRY UNIT 1 RECOVERY STATUS; 2.) MEETING OF THE NRC RESTART PANEL FOR THE BROWNS FERRY UNIT 1 RECOVERY; 3.) PERFORMANCE ASSESSMENT OF BROWNS FERRY UNIT 1 - DOCKET NO. 50-259
Dear Mr. Singer:
This refers to the public meeting conducted at Calhoun Community College located near Decatur, Alabama on August 3, 2006. The purpose of the meeting was to discuss the Browns Ferry Unit 1 (BF1) Restart Project Status. Discussions during this meeting included the following topics: Unit 1 schedule, returning systems to service, emerging issues, regulatory status, and operational readiness. Enclosure 1 contains a list of attendees. Enclosure 2 contains the NRC Browns Ferry Unit 1 Recovery Issues List which represents the NRCs understanding of the issues requiring NRC review prior to restart of Unit 1. Enclosure 3 contains the presentation material used by your staff to discuss the status of the Browns Ferry Unit 1 Restart Project. The list is current as of August 3, 2006, the date of the meeting.
The meeting was informative and a beneficial exchange of information. As a result of the meeting the NRC will continue to work with your staff in understanding which procedures applicable to fire protection operator manual actions will be completed prior the NRCs Triennial Fire Inspection of BF1. In addition the NRC informed TVA that any change in BF1 restart scheduling could potentially impact NRCs resources and schedule for inspections of system readiness and start up assessment inspections. During the meeting the NRC noted that your staff presentation emphasized continued safe operation of Units 2 and 3 while maintaining a focus on the Unit 1 scheduled restart date. The NRC stated that we will continue to maintain and ensure public health and safety as its overriding priority of the operating Unit 2 and 3 and throughout the Unit 1 recovery process.
In addition, on August 3, 2006, the Nuclear Regulatory Commission (NRC) held an internal meeting of the NRC Browns Ferry 1 (BF1) Restart Oversight Panel at the Browns Ferry site.
The purpose of this panel meeting was to discuss NRC perspectives on the BF1 restart project status, results from recent NRC inspections of BF1, status of notable licensing actions, and recent issues important to NRC oversight and inspections. The panel was established in accordance with NRC Inspection Manual Chapter (IMC), IMC 2509, Browns Ferry Unit 1 Restart Project Inspection Program. The purpose of IMC 2509 is to provide the policies and requirements for the restart inspection program, to establish a BF1 Restart Oversight Panel, and to document the major regulatory and licensee actions associated with the restart.
2 TVA MC 2509 Browns Ferry Unit 1 Restart Project Inspection Program Section 05.10.b specifically states that the Restart Oversight Panel will provide licensee performance assessment periodically prior to restart. The Restart Oversight Panel has determined that guidance contained in sections of MC 0305 "Operating Reactor Assessment Program," referring to performance assessments are not fully applicable to BF1. The assessment program for BF1 recovery process will only collect information from inspections until a full transition into the Reactor Oversight Process (ROP) has been completed. Currently four (4) cornerstones are under the ROP (MC 305): Occupational Radiation Safety, Public Radiation, Emergency Preparedness, and Physical Protection. All other cornerstones are being monitored through the inspection findings and corrective action process. The Panel uses the inspection findings to determine the adequacy of the licensees performance.
Because TVAs recovery effort is intended to ensure full compliance and because BF1 has no discernable risk in its present defueled state, neither MC 2515 nor the present guidance for performance indicators (PIs) are fully applicable. However, using this program documentation as a guide, inspection findings for the past six months would be classified as having very low safety significance and would require no additional NRC oversight. The NRC identified several weakness, deficiencies and non-cited violations throughout the assessment period which are captured and addressed in the licensees corrective action program (CAP) and all are dispositioned using traditional enforcement. The Panel assessment of the recovery effort to date indicates that TVA has performed work in a safe manner that promotes maintaining and protecting public health and safety.
The NRC plans to continue to conduct non-ROP inspections including system readiness inspections, operational readiness assessment inspections and ongoing BF1 recovery and restart inspections through a standard assessment cycle which would cover through March 31, 2007.

Prior to the Unit 1 recovery, additional Special Programs existed which were closed and/or combined with the remaining 27. This matrix identifies all 30 Special Program areas in order to clarify how several programs have been consolidated into the inspection process based on how the issues were reviewed for the Unit 2 and 3 recoveries.
