REQUEST FOR AN EXTENSION OF TIME TO RESPOND TO NOTICE OF VIOLATION AND PROPOSED IMPOSITION OF CIVIL PENALTIES

Dear Mr. Leidich:

This refers to your letter dated July 8, 2005, in which you requested an extension of 120 days to respond to the Notice of Violation and Proposed Imposition of Civil Penalties (Notice) issued by the Nuclear Regulatory Commission (NRC) to FirstEnergy Nuclear Operating Company (FENOC) on April 21, 2005. Our April 21, 2005, Notice required FENOC to respond to the Notice within 90 days of date of the Notice, i.e., by July 20, 2005.

In your July 8th letter, you based your extension request on the ongoing Department of Justice investigation related to the subject matter of the Notice and the NRC staff request for continuance of 120 days to the Atomic Safety and Licensing Board. Under the circumstances, the NRC is granting an extension for FENOC to respond to the Notice and pay the civil penalties commensurate with the NRC staff request for continuance. Therefore, please provide your response to the Notice no later than September 14, 2005, which is 120 days after the NRC staff request for continuance dated May 17, 2005.

In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will be made available electronically for public inspection in the NRC Public Document Room or from the NRCs document system (ADAMS), accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
