\FISH AND WILDLIFE SERVICE' 1875 Century Boulevard Atlanta, Georgia 30345 MIGRATORY BIRD DEPREDATION PERMIT STANDARD CONDITIONS
- 1. Any person who is under the direct control of the permittee,,or who is employed by or under contract to the permittee for purposes authorized by this permit, may carry out the activity authorized by this permit.
- 2. Direct control of the permittee means that the permittee and the subpermittee have entered Into an identifiable relationship where there is evidence that the permittee has relayed instructions outlining the authority given to the subpermittee for activities authorized by this permit.
- 3. Permittee and all subpermittees, shall carry a legible copy of this permit and display upon request, whenever exercising its authority.
- 4. Failure to comply with ANY of these conditions listed may result in the immediate suspension of this permit.
S. Authorization granted herein shall not be exercised contrary to the laws of the appropriate State, County, Municipal, Tribal, or Foreign government or any other applicable law.
- 6. Permittee must maintain records which include the following information: Species (common name),
month taken, location (county and state), number of birds killed or relocated, number of eggs taken or relocated, name of person taking birds and the final disposition of the birds or eggs.
- 7. All records relating to permitted activities shall be kept at the locationts) as indicated in writing by permittee to the issuing office.
S. This permit does not authorize trespass or the taking of birds, nests or eggs on State and/or Federal lands without written permission.
- 9. No species may be taken which are on the United States List of Threatened and Endangered Species. No bald or golden eagles may be taken.
- 10. Acceptance of this permit authorizes inspection in accordance with So CFR 13.47.
- 11. No blinds, pits, or other means of concealment, decoys, duck calls, or other devices can be used to lure or entice birds within gun or trap range.
- 12. , If take is by shotgun, it can be no larger' than No. 10 gauge and must be fired from the shoulder. Except when nontoxic shot is not produced in the size required, nontoxic shot must be used over open water or a wetland unless otherwise authorized in Condition D of this permit.
- 13. Permittee is required to continually use nonlethal methods of harassment alternately with lethal control.
- 14. Birds, nests or eggs taken under this permit must be (1) turned over to the U.S. Department of Agriculture for official purposes, (2) donated to a public educational or scientific institution as defined in So CFR 10, (3) completely destroyed by burial or incineration or (4) as directed in Condition D of this permit.^
- 15. Any killing of game birds during the open hunting season for those species must be in accordance with all State and Federal hunting regulations unless otherwise authorized on the face of this permit.,
