L-2012-149 U.S. Nuclear Regulatory Commission Document Control Desk Washington, D.C. 20555-0001 Re: Turkey Point Nuclear Generating Station Units 3 and 4 Docket Nos. 50-250 and 50-251 License Amendment Request No. 215 Withdrawal of Request for Revision of the Turkey Point Nuclear Generating Station License Condition 3.D, Fire Protection, dated February 28, 2012 By letter dated February 28, 2012 (Letter L-2012-067), Florida Power & Light Company (FP&L) requested a revision to the Turkey Point Nuclear Generating Station (Turkey Point) Units 3 and 4 Renewed Facility Operating Licenses. The request involved incorporating a previously approved exemption into License Condition 3.D, Fire Protection for both Turkey Point Units 3 and 4.

In conversation with the NRC Project Manager on March 28, 2012, the NRC requested that this request be withdrawn. The NRC's cited view is that exemption approval dates do not need to be added to the fire protection license conditions. This view was previously communicated to Entergy Nuclear Operations, Inc. on June 10, 2008 (NRC to Entergy Operations, Inc., "Indian Point Nuclear Generating Unit Nos. 2 and 3 - Withdrawal of an Amendment Request Regarding Fire Protection License Conditions (TAC Nos. MD4921 and MD4922)," NRC Accession No. ML081440422).

Based on this information and the communicated NRC view, FP&L withdraws the subject requested revision to the Turkey Point Units 3 and 4 License Condition 3.D, Fire Protection.
