NRC Letter to Florida Power and Light Company dated February 7, 2011 Florida Power and Light Company, the licensee for the Turkey Point Nuclear Plant, Units 3 and 4, hereby submits a Reply to the Notice of Violation contained in the above referenced correspondence. The Reply to the Notice of Violation is attached.

Florida Power and Light Company Letter L-2011-083 Attachment - Reply to Notice of Violation: EA- 10-241 Page 1 of 2 ATTACHMENT Reply to Notice of Violation: EA- 10-241 The NRC Letter to Florida Power and Light Company (FPL) dated February 7, 2011 identified a violation of NRC requirements. The violation and FPL's reply follow.

Violation 10 CFR 73.22(c)(2) states that while unattended, Safeguards Information (SGI) must be stored in a locked security storage container.

Contrary to the above, from November 9, 2009 through March 17, 2010, the licensee failed to store SGI in a locked security storage container while unattended. Specifically, an NRC force-on-force inspection report was stored in an unlocked desk drawer but within the protected area.

FPL Reply FPL admits the violation.

Reasons for the Violation The process for receipt of NRC SGI correspondence lacked sufficient rigor. The process allowed personnel that lack a high level of SGI awareness to receive documents containing SGI for the station.

Corrective Steps Taken to Avoid Further Violations and the Results Achieved The FPL nuclear fleet Regulatory Correspondence procedure was revised was revised to specify that only the site Security manager and Nuclear Fleet Security be included on the NRC's Service List Distribution for SGI.

A request to the NRC for SGI distribution to site Security Managers and Nuclear Fleet Security only was made by FPL letter L-2010-145 dated August 3, 2010.

FPL fleet procedure SY-AA-102-1000, Safeguards Information Program, was revised to require Security to review distribution lists in NRC correspondence containing SGI. The purpose of the review is to verify that SGI has not been forwarded to personnel other than Security. Additional guidance for receiving NRC SGI correspondence was also incorporated for all personnel.

This action was intended as a defense-in-depth measure to ensure that this population of employees knows how to treat SGI in the event of receipt.

There have been no further instances of loss of control of NRC-sent SGI at Turkey Point.

Date When Full Compliance Will Be Achieved Full compliance was achieved on March 17, 2010 when the uncontrolled SGI was placed into the SGI control program.
