SUBJECT:

MCGUIRE NUCLEAR STATION, UNITS 1 AND 2 - U.S. NUCLEAR REGULATORY COMMISSION SECURITY INSPECTION REPORT 05000369/2018411 AND 05000370/2018411

Dear Mr. Kinard:

On July 26, 2018, the U.S. Nuclear Regulatory Commission (NRC) completed a security inspection at your McGuire Nuclear Station, Units 1 and 2, and discussed the results of this inspection with Mr. S. Snider, and other members of the McGuire Nuclear Station staff. The results of this inspection are documented in the enclosed report.

The NRC inspectors documented a finding of very low security significance (Green) in this report. This finding involved a violation of NRC requirements. The NRC is treating this violation as a non-cited violation (NCV) consistent with Section 2.3.2.a of the Enforcement Policy.

If you contest the violation or the significance of the NCV, you should provide a response within 30 days of the date of this inspection report, with the basis for your denial, to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555-0001; with copies to the Regional Administrator, Region II; the Director, Office of Enforcement; the Director, Office of Nuclear Security and Incident Response; and the NRC resident inspector at the McGuire Nuclear Station.

A cross-cutting aspect was assigned to the finding in the area of Human Performance, Avoid Complacency. Specifically, because McGuire Nuclear Station failed to recognize and plan for the possibility of mistakes, latent issues, and inherent risk, even while expecting successful outcomes (H.12).

If you disagree with the cross-cutting aspect assignment in this report, you should provide a response within 30 days of the date of this inspection report, with the basis for your disagreement, to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555-0001; with copies to Regional Administrator, Region II, and the NRC Resident Inspector at McGuire Nuclear Station.

This letter will be made available for public inspection and copying at https://www.nrc.gov/reading-rm/adams.html and at the NRC Public Document Room in accordance with 10 CFR 2.390, Public Inspections, Exemptions, Requests for Withholding.

However, the enclosed report contains Security-Related Information, so the enclosed report will not be made publicly available in accordance with 10 CFR 2.390(d)(1). If you choose to provide a response that contains Security-Related Information, please mark your entire response Security-Related Information-Withhold from public disclosure under 10 CFR 2.390 in accordance with 10 CFR 2.390(d)(1) and follow the instructions for withholding in 10 CFR 2.390(b)(1). The NRC is waiving the affidavit requirements for your response in accordance with 10 CFR 2.390(b)(1)(ii).
