FARLEY NUCLEAR PLANT, UNITS 1 & 2 - 95002 SUPPLEMENTAL INSPECTION REPORT 05000348/2023441 AND 05000364/2023441 AND FOLLOW-UP ASSESSMENT LETTER

Dear R. Keith Brown:

On September 1, 2023, the U.S. Nuclear Regulatory Commission (NRC) completed a supplemental inspection and discussed the results of this inspection and the implementation of your corrective actions with D. Erb and other members of your staff.

We performed this inspection to review your stations actions in response to a finding which was documented and finalized in NRC Inspection Reports 05000348/2022440 and 05000364/2022440 and 05000348/2023440 and 05000364/2023440.

On July 26, 2023, Southern Nuclear Operating Co., informed the NRC that Farley Nuclear Plant, Units 1 and 2 was ready for the supplemental inspection.

The NRC determined that completed or planned corrective actions were sufficient to address the performance issue that led to the Greater-than-Green finding. Therefore, the performance issue will be closed and no longer considered as an Action Matrix input as of September 1, 2023. Based on the results of this inspection and our Action Matrix assessment, the NRC has determined that Farley Nuclear Plant, Units 1 and 2 will be transitioned to the Licensee Response Column (Column 1) of the Action Matrix as of September 1, 2023.

Notwithstanding the above, the inspection team did identify some general weaknesses. Your staff acknowledged and appropriately addressed these weaknesses following interactions with the NRC inspectors. A discussion of these issues is included in the enclosed report.

Two findings of very low security significance (Green) are documented in this report. The findings involved violations of NRC requirements. We are treating these violations as non-cited violations (NCVs) consistent with Section 2.3.2 of the Enforcement Policy.

Document Control Desk, Washington, DC 20555-0001; with copies to the Regional Administrator, Region II; the Director, Office of Enforcement; the Director, Office of Nuclear Security and Incident Response; and the NRC Resident Inspector at Farley Nuclear Plant, Units 1 & 2.

The following cross cutting aspects were assigned to findings using Inspection Manual Chapter 0310 Aspects Within Cross Cutting Areas: [P.1] - Identification and [P.3] - Resolution.

If you choose to provide a response that contains Security-Related Information, please mark your entire response Security-Related Information-Withhold from public disclosure under 10 CFR 2.390 in accordance with 10 CFR 2.390(d)(1) and follow the instructions for withholding in 10 CFR 2.390(b)(1).
