AMENDMENT OF ORDER PROHIBITING INVOLVEMENT IN NRC-LICENSED ACTIVITIES (NRC SPECIAL INSPECTION REPORT NO. 50-346/2002-08 (DRS))

Dear Mr. Siemaszko:

On April 21, 2005, the U.S. Nuclear Regulatory Commission (NRC) issued an order prohibiting you from involvement in NRC-licensed activities for a period of five years. The order was based on the NRCs determination that it lacked reasonable assurance that NRC-licensed activities can be conducted in compliance with the Commissions requirements and the health and safety of the public will be protected if you are permitted to be involved in NRC-licensed activities.

That order was premised on the examples described therein which establish that you had deliberately provided incomplete and inaccurate information to the FirstEnergy Nuclear Operating Company (FENOC), a NRC licensee, in violation of 10 CFR 50.5(a)(2).

Enclosed is an Amendment of Order which provides notice of additional examples further substantiating the violation of 10 CFR 50.5(a)(2) cited in the April 21, 2005, order with respect to your deliberate submission of incomplete and inaccurate information to FENOC and the NRC. This Amendment of Order does not otherwise alter the statements or terms of the April 21, 2005, order.

A copy of this letter and its enclosure is being sent to FENOC, the operator of the Davis-Besse Nuclear Power Station.

This letter will be maintained by the Office of Enforcement in an NRC Privacy Act system of records, NRC-3, Enforcement Actions Against Individuals. In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter, its enclosure, and your response will be made available electronically for public inspection in the NRC Public Document Room or from the NRCs document system (ADAMS), accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html. To the extent possible, your response should not include any personal privacy, proprietary, or safeguards information so that it can be made available to the public without redaction. If personal privacy or proprietary information is necessary to provide an acceptable response, then please provide a bracketed copy of your response that identifies the information that should be protected and a redacted copy of your response that deletes such information. If you request withholding of such material, you must specifically identify the portions of your response that you seek to have withheld and provide in detail the bases for your claim of withholding (e.g., explain why the disclosure of information will create an unwarranted invasion of personal privacy or provide the information required by 10 CFR 2.390(b) to support a request for withholding confidential commercial or financial information). If safeguards information is necessary to provide an acceptable response, please provide the level of protection described in 10 CFR 73.21.
