This refers to tl.e Unresolved item (90-27-01) identified in the Nuclear Regulatory Comission's (NRC) Inspection Report Nos. 50-338/90-27 and 50-339/90-27, issued to Virginia Electric and Power Company by letter dated November 27, 1990.

The Unresolved item pertains to your pr9viding access to or copies of all test records to an individual subject to 10 CFR Part 26, as required by Appendix A. Subpart C, Section 3.2.

Af ter careful review of this matter, our position remains as stated in our letter of November 27, 1990.

The NRC expects licensee management to provide workers with direct access to or copies of all records, documents, and chain of custody forms relating to the findings of initibi and confirmatory positive fitness-for-duty test results.

Therefore, upon receipt of this letter, we expect you to provide access to or copies of the aforementioned documents to the individual w'no has been requesting them.

This will close the Unresolved item discussed in the subject report.

Since there may have been some confusion concerning the requirements of the new 10 CFR Part 26, the NRC has determined not to cite Virginia Electric and Power Company in this case, assuming you are going to provide access to or copies of the documents as stated above, future failure to provide access to or copies of all test records relating to fitness-for-duty tests to individuals upon request could result in enforcement action.
