Notice of Violation (Inspection Report 50-312/86-04)

This refers to a special announced team inspection conducted of activities authorized by NRC Operating License DPR-54 at the Rancho.Seco Nuclear Power

,

-Plant on February 3-7, 1986.

Several violations of NRC security requirements

-

were reviewed that were previously identified and documented by your staff.

These violations were' discussed with you and members of your staff during an enforcement conference held in the NRC Region V office on March 4, 1986 (Inspection Report.50-312/86-04).

We have concluded from the number of apparent violations identified in various

,

areas of your. security program that management has not exercised effective control and oversight of the program.

However, we recognize that these violations occurred prior to the significant enforcement action that resulted

,

from an earlier special team inspection conducted from November 14 - December 12, 1985 (Inspection Report 50-312/85-34).

Violations i'n various areas of security were identified and a Notice of Violation and Proposed Imposition of Civil Penalty was issued on February 5,1986.

As'a result you initiated comprehensive corrective measures for these violations.

You also submitted a Performance Improvement Plan (PIP) on March IC 1986 which addresses improvement in the management controls in your snbrt y program, as well as specific corrective

measures to preclude the t W h of iolations included in this proposed enforcement action.

In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1985), the violations described in the enclosed Notice have been categorized in the aggregate as a Severity Level III problem.

Normally, a civil penalty is considered for a Severity Level III violation or problem.

However, after consultation with the Director, Office of Inspection and Enforcement, I have decided that a civil penalty will not be proposed in this case because of your extensive corrective actions, including the implementation of the PIP.

y You are required to respond to this letter and should follow the instructions

specified in the enclosed Notice when preparing your response.

In your response, you should document the specific actions taken and any additional actions you plan to prevent recurrence. After reviewing your response to this

Sacramento Municipal-2-MAY 131986 Utility District Notice, including your proposed corrective actions, the NRC will ' determine whether further NRC enforcement action is necessary to ensure compliance with NRC regulatory requirements.

In accordance with Section 2.790(d) of the NRC's Rules of Practice", Part 2, Title 10, Code of Federal Regulations, documentation of the findings of your safeguards and security measures are exempt from public disclosure; therefore, the enclosed Notice of Violation will not be placed in the Public Document Room and will receive limited distribution.

We have determined that the enclosures so designated contain Safeguards Information and therefore are subject to the controls of 10 CFR 73.21.

The responses directed by this letter and the enclosed Notice are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
