NOTICES OF VIOLATION (NRC INSPECTION REPORTS N0. 50-295/89005(DRSS);
50-304/89005(DRSS); 50-295/89003(DRSS); AND 50-304/89003(DRSS))
-This refers to two NRC inspections which were in response to two radioactive material transportation incidents and a security event at the Zion Nuclear Power Station.
The inspections were conducted during the period December 15, 1988 through January 4, 1989 and January 10 through 24, 1989. The inspection reports were forwarded to you on January 27 and February 10, 1989, respectively. On February 16, 1989 we held an enforcement conference with Mr. K. Graesse~ and others of your staff to discuss the violations, root causes, and corrective actions.
The violations described in Appendix A concern your radioactive material-transportation program. As a result of two incidents, both of which occurred on November 18, 1988, four violations of NRC requirements were identified.

The incidents, which were identified by the consignee and reported by you to the NRC, involved the failure to:
1) properly mark and label an overpack; 2) complete shipping papers; 3) perform tests or examinations to ensure proper packaging and preparation; and 4) meet Low Specific Activity transport requirements for package marking and carrier instructions.
Although these violations were initially considered as a Severity Level III problem, classification of each violation at Severity Level IV is appropriate because the violations had minor safety significance, were isolated, and had l
separate root causes.
In your response, yos are requesten ;o provide corrective action regarding how you intend to strengthen v itrols in the radioactive material transportation area throughout Commo nealth Edison Company as a result of these events.
The violation described in Appendix B involved an event in which a portion of a vital area barrier was degraded and adequate compensatory measures were not in effect. The violation resulted from inadequate communications between contractor employees and members of your security staff. You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response.
In your response, you should document the specific actions taken and any additional

actions you plan to prevent recurrence. After reviewing your response to this l
Notice, including your proposed corrective actions and the results of future inspections, the NRC will determine whether further NRC enforcement action is necessary to ensure compliance with NRC regulatory requirements.
In accordance with Section 2.790 of the NRC's " Rules of Practice, W t 2, Title 10, Code of Federal Regulations, a copy of this letter and Enclosures 1 and 3 will be placed in the NRC Public Document Room.

Security matters examined during this inspection concern a subject mat,2r that
,
is exempt from disclosure under 10 CFR Section 73.21(c)(2) of the NRC's
Regulations.
Consequently, Enclosures 2 and 4 and your response to the violation identified in Appendix B will not be placed in the Public Document Room.
Therefore, your statement of corrective action regarding the violation identified in Appendix B should be submitted as a separate enclosure to your transmittal letter.
The response directed by this letter and the enclosed Notice are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, Pub.
