Box 770000 San Francisco, California 94177 SUBJECT: NRC INSPFCTION REPORT 50-275/95-02: 50-323/95-02 ANO NOTICE Of VIOLAIION This refers to the inspection conducted by M. Miller, and the inspectors identified in the enclosed report, of this office on January 8 through February 18.

1995.

The inspection included a review of activities authorized for your Diablo Canyon Nuclear Power Plant, Units I and 2. facility.

At the conclusion of the inspection.

the findings were discussed with those members of your staff identified-in the enclosed report.

Areas examined during the inspection are identified in the report.

Within these areas, the inspection consisted of selective examinations of procedures and representative records, interviews with personnel, and observation of activities in progress.

The purpose of the inspection was to determine whether activities authorized by the license were conducted safely and in accordance with NRC requirements.

Based on the results of this inspection, certain licensed activities appeared to be in violation of NRC requirements, as speci fied in the enclosed Notice of Violation (Notice).

The violation is of concern because it involved the failure to comply with a procedure for operation of the reactor trip bypass breakers that required concurrert performance verification.

Although we acknowledge that the actions taken by the operators accomplished the intent of the procedure to rack out the breaker, the violation is being cited because of our concern that operators not work around procedure requirements.

We are concerned that your recent action's taken to improve performance in the area of procedure compliance have not been fully effective and urge you to assure that your expectations for performance tn these areas are clearly communicated, understood, and implemented by all of your staff.

Your actions to identify and evaluate the improper electrical separation of the solid state protection system (SSPS) input circuits from engineered safety feature power supplies demonstrated a high level nf safety sensitivity and focused the industry's attention on the potential safety significance of this issue.

Your prompt communication to the NRC, subsequent request for enforcement discretion, and corrective actions were al'.o performed in an 9504210274 950417 PDR ADOCK 05000275 Q PDR

An unresolved item was identified on this issue pending NRC determination of the appropriate action tu be taken for the root cause of the SSPS problem.

You are required to respond to this letter and should fo11ow the instructions specified in the enclosed Notice when preparing your response.

In your response, you should <Iucument the specific actions taken and any additional actions you plan to prev< nt recurrence.

Your response may reference or include previous docketed correspondence, if the correspondence adequately addresses the rs quired response.

After reviewing your response to this Notice, including your proposed corrective actions and the results of future inspections.

the NRC will determine whether further NRC enforcement action is necessary to ensure compliance with NRC regulatory requirements.

In accordance with

CFR 2.790 of the NRC's "Rules of Practice," a copy of this letter, its enclosure(s), and your response will be placed in the NRC Public Document Room (PDR).

To the extent possible.

your response should not include any persona! privacy, proprietary, or safeguards information so that it can be placed in the PDR without redaction.

However, if you find it necessary to include such information.

you should clearly indicate the specific information that you desire not to be placed in the PDR, and provide the legal basis 'o support your request for withholding the information from the public.

The responses directed by this letter and the enclosed Notice are not.subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, Pub.
